RESOLUTION FIXING THE TIME AND PLACE OF
HEARING TO BE GIVEN ON APPLICATION OF LOCKARD
DEVELOPMENT INC. , HURST HOLDING CO. AND J & S
REALTY, LLC TO REZONE FROM "A-1" AGRICULTURAL
DISTRICT TO "C-2" COMMERCIAL DISTRICT
PROPERTY GENERALLY LOCATED AT THE NORTHWEST
CORNER OF TOWER PARK DRIVE AND JOHNATHAN
STREET, JUST WEST OF THE NEW LINCOLN SAVINGS
BANK IN THE TOWER PARK AREA, AS JULY 28,
2003, AT 5: 30 P.M. IN THE COUNCIL CHAMBERS IN
CITY HALL AND INSTRUCTING CITY CLERK TO
PUBLISH NOTICE OF HEARING.
WHEREAS, the Council of the City of Waterloo, Iowa, shall
meet in the Council Chambers in the City Hall in the City of
Waterloo, Iowa, at 5: 30 p.m. on the 28th day of July, 2003, for
the purpose of considering and acting upon an application of
Lockard Development, Hurst Holding Co. and J & S Realty, LLC to
rezone from "A-1" Agricultural District to "C-2" Commercial
District, property generally located at the northwest corner of
Tower Park Drive and Johnathan Street, just west of the new
Lincoln Savings Bank, for development of an auto dealership and
legally described as follows:
A part of the Northeast of Section 9-88-13, Waterloo,
Black Hawk County, Iowa, described as follows:
Commencing at the Northeast corner of the Northwest 141
of the Northeast 1/ of said Section 9; thence South
00°26' 14" East along the East line of the Northwest
of the Northeast of said Section 9 a distance of
63. 43 feet to the Southerly right-of-way line of W. San
Marnan Drive; thence North 89°03' 48" West along said
right-of-way line a distance of 40. 01 feet to the
Westerly right-of-way line of Johnathan Street; thence
South 00°26' 14" East along said Westerly right-of-way
line a distance of 10.27 feet; thence Southeasterly
along said Westerly right-of-way line on a curve
concave Northeasterly having a radius of 230. 00 feet
and a long chord bearing South 21°10' 56" East a
distance of 166. 56 feet to the point of beginning;
thence Southeasterly along said right-of-way line along
a curve concave Northeasterly, having a radius of
230. 00 feet and a long chord bearing South 43°41' 08"
East a distance of 14 . 06 feet; thence South 45°26' 14"
East along said right-of-way line a distance of 75. 04
feet; thence Westerly along a curve concave Southerly,
having a radius of 15. 00 feet and a long chord bearing
South 89°33' 46" West a distance of 23 . 56 feet; thence
South 44°33' 46" West a distance of 29. 56 feet; thence
Southwesterly along a curve concave Northwesterly
having a radius of 210. 00 feet and a long chord bearing
South 51°14' 14" West a distance of 48 . 93 feet to the
East line of the Northwest of the Northeast y of said
Section 9; thence North 00°26' 14" West along said East
line of the Northwest of the Northeast 1/ a distance
of 76. 85 feet; thence North 44°33' 46" East a distance
of 24 . 16 feet; thence Northeasterly along a curve
concave Northwesterly having a radius of 15. 00 feet and
a long chord bearing North 01°19' 04" East a distance of
22.64 feet to the point of beginning.
