RESOLUTION FIXING THE TIME AND PLACE OF
HEARING TO BE GIVEN ON APPLICATION OF
CLARENCE H. SCHUKEI ESTATE LIQUIDATING TRUST
TO REZONE FROM "A-1" AGRICULTURAL DISTRICT TO
"C-2" COMMERCIAL DISTRICT PROPERTY GENERALLY
LOCATED ON SCHUKEI ROAD NEXT TO ALDI' S FOOD
STORE TO ALLOW FOR FUTURE EXPANSION OF THE
ALDI' S FOOD STORE, AS AUGUST 4, 2003, AT 5 :30
P.M. IN THE COUNCIL CHAMBERS IN CITY HALL AND
INSTRUCTING CITY CLERK TO PUBLISH NOTICE OF
HEARING.
WHEREAS, the Council of the City of Waterloo, Iowa, shall
meet in the Council Chambers in the City Hall in the City of
Waterloo, Iowa, at 5: 30 p.m. on the 4th day of August, 2003, for
the purpose of considering and acting upon an application of
Clarence H. Schukei Estate Liquidating Trust to rezone from "A-1"
Agricultural District to "C-2" Commercial District property
generally located on Schukei Road next to Aldi' s Food Store to
allow for future expansion of the Aldi' s Food Store and legally
described as follows :
Unplatted Waterloo West point of South 40 acres of
North of Southwest 14i Section 2 Township 88 Range 13
beginning at a point on Northwesterly line Lot 5
Schukei Commercial Park that is 121. 05 feet mostly
Northeasterly of most Westerly corner of said Lot 5;
thence due North 259. 67 feet; thence East along North
line of South 40 acres of North of Southwest 1-1 said
Section 279 feet; thence Southwesterly along
Northwesterly line of Schukei Commercial Park 381 . 14
feet to the point of beginning Section 2 Township 88
range 13 except that part contained in the following
description:
Commencing at the Northwest corner of the Southwest
Section 2; thence Southwest along the West line of
Southwest 1/ a distance of 667 . 22 feet to the South line
of the North 40 acres of Southwest d; thence North
89°15' 15" East along said South line a distance of
1394 . 97 feet to the point of beginning; thence
Northerly along a non-tangent curve concave to the East
having a radius of 331 .28 feet a central angle of
38°55' 20" a chord bearing North 20°3' 25" West a chord
length of 220. 75 feet an arc distance of 225. 05 feet ;
thence Northwest a distance of 77 .22 feet; thence North
89°24' 15" East a distance of 60 feet; thence Southeast
a distance of 77 .22 feet; thence along a tangent curve
concave to the East having a radius of 271 .28 feet a
central angle of 41°22' 25" a chord bearing South 21°17'
East a chord distance of 191 . 66 feet an arc distance of
195. 89 feet; thence South 41°58' 10" East a distance of
38 . 15 feet more or less to the South line of said North
40 acres; thence North 89°15' 15" East along said South
line a distance of 33. 14 feet to the intersection of
the Northwesterly line of Schukei Commercial Park as
platted; thence South 48°1' 50" West along said
Northwesterly line a distance of 84 . 92 feet more or
less to the Westerly line of Schukei Road (previously
known as Action Blvd) as platted in said addition;
thence North 41°58' 10" West a distance of 60 feet;
