RESOLUTION NO. 2003-519
RESOLUTION GRANTING PERMISSION TO DUANE
WESSELS FOR A WAIVER FOR A CONCRETE DRIVEWAY
TO BE LOCATED AT 213 NIAGARA DRIVE, AND
AUTHORIZING CONSTRUCTION OF A CONCRETE
DRIVEWAY WITH THE ELIMINATION OF THE SIDEWALK
SECTION DUE TO THE INABILITY TO MEET
REQUIREMENTS OF THE DRIVEWAY AND SIDEWALK
POLICY, PARAGRAPH 1 .
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF WATERLOO, IOWA:
WHEREAS, the City Engineer has made written application to
the City Council asking that Duane Wessels be authorized and
permitted to construct a concrete driveway with the elimination
of the sidewalk section due to the inability to meet requirements
of the driveway and sidewalk policy, paragraph 1, to be located
at 213 Niagara Drive, and legally described as follows :
Auditor Whitney Road Plat parcel of land known as Lot 4
Wessels Minor Plat as described in Certificate of
Survey Book 312 Page 484 contained in the following
described:
Lot 62 except East 150 feet in even width of that part
lying South of South line Northeast Southeast Section
17 Township 89 Range 13 except East 25 feet in even
width of that part lying North of South line Northeast
Southeast said Section and except 1 Rod in width off
the Northerly side lying next to and adjacent right-of-
way of Waterloo Railroad Company and except that part
said Lot 62 beginning at Southwest corner Lot 1 in
Hillside Addition thence West along extended South line
said Lot 1 to West line said Lot No. 62 thence South
along West line said lot to Southwest corner said lot
thence Southeasterly along Southwesterly line said lot
to a point 150 feet due West of East line said lot
thence North along West line of East 150 feet said lot
to place of beginning and except that part said Lot 62
beginning at Northeast corner Lot 4 Hillside Addition
thence Westerly along Northerly line said Lot 4
distance of 125 feet thence Northerly parallel with
Westerly line Niagara Drive distance of 90 feet thence
Easterly to point on Westerly line of Niagara Drive
that is 90 feet Northerly of point of beginning as
measured along Westerly line Niagara Drive thence
Southerly to point of beginning and except that part
described as follows :
Commencing at Northeast corner Lot 4 Hillside Addition
thence North along West line Niagara Drive 190 feet to
point of beginning thence continuing North along said
West line Niagara Drive 110 feet thence West parallel
North line said Hillside Addition 125 feet thence South
parallel to said West line Niagara Drive 110 feet
thence East parallel said North line Hillside Addition
125 feet to point of beginning (described as Parcel "A"
in Plat of Survey Book 308 Page 42) , all in the City of
Waterloo, Black Hawk County, Iowa;

and
WHEREAS, it is the sense of the Council of the City of
Waterloo, Iowa, that said request should be granted.
NOW, THEREFORE, BE IT FURTHER RESOLVED that permission is
hereby granted to Duane Wessels to construct a concrete driveway
subject to the following conditions :
1 . Work to be performed by an approved and bonded
contractor.
2 . A permit is to be obtained from the office of the City
Engineer prior to construction.
3 . All work shall be performed under the supervision of
the City Engineer and at no cost to the City of
Waterloo.
BE IT FURTHER RESOLVED that the City Clerk is authorized and
directed to forward a certified copy of this resolution to the
Black Hawk County Recorder for recording and the Black Hawk
County Auditor for filing in order that this said action may
become a matter of official County Record.
PASSED AND ADOPTED this 4th day of A oust, 2003 .
