RESOLUTION NO. 2003-549
RESOLUTION AUTHORIZING THE SALE AND
CONVEYANCE OF PROPERTY GENERALLY LOCATED AT
THE NORTHERLY END OF ENGLEWOOD AVENUE AND THE
EASTERLY END OF STRATFORD STREET FOR
$2, 000.00, PLUS COSTS AND AUTHORIZING THE
MAYOR AND CITY CLERK TO EXECUTE AND DELIVER A
DEED FOR SAME.
WHEREAS, the City of Waterloo, Iowa, is the owner of real
property in the City of Waterloo, Iowa, as described below, and
WHEREAS, an offer to purchase said certain parcel of real
property has been made by Steven and Lori Harvey in the sum of
$2, 000. 00, plus costs and,
WHEREAS, a public hearing was held on August 18, 2003, at
5:30 p.m. in the Council Chambers in City Hall, Waterloo, Iowa,
as provided by law, by the Council of the City of Waterloo, Iowa,
on the proposal to sell and convey premises owned by the City of
Waterloo, Iowa, to Steven and Lori Harvey, and
WHEREAS, it is the opinion of this Council that sale and
conveyance should be made as proposed.
NOW, THEREFORE, IT IS HEREBY RESOLVED BY THE COUNCIL OF THE
CITY OF WATERLOO, IOWA, AS FOLLOWS:
1 . The following described real property, as fully
described in the published notice in the Waterloo Courier on
August 6, 2003, is not presently needed and will not be needed in
the foreseeable future for municipal purposes and its ownership
is serving no municipal purpose, and
2 . That the offer of Steven and Lori Harvey to purchase
real property for the sum of $2, 000. 00, plus costs, be, and it is
hereby accepted for real property described below:
That part of Stratford Avenue lying northerly of Lot
201, of Galloway Addition, City of Waterloo, Black Hawk
County, Iowa, described as follows:
Beginning at the Northwesterly corner of said Lot 201;
thence North 00° (degrees) 14' (minutes) 31" (seconds)
East, 60.00 feet to a point on the Northerly right-of-
way line of Stratford Avenue, said point being the
Southwesterly corner of Lot 202 of said Galloway
Addition; thence South 89°53' 58" East on the Northerly
right-of-way line of Stratford Avenue, 59. 10 feet to
the Iowa Department of Transportation' s right-of-way
line; thence South 42°05' 22" East on the Iowa
Department of Transportation' s right-of-way line, 80. 98
feet to the Southerly right-of-way line of Stratford
Avenue; thence North 89°53' 58" West on the Southerly
right-of-way line of Stratford Avenue, 113. 63 feet to
the point of beginning, with the city' s retention of a
permanent easement over, under and above the above
described property.

the above described property.
The Westerly right-of-way line of Englewood Avenue is
assumed to bear North 00°00' 00" East for the purpose of
this description, containing by survey 2, 036 square
feet, all in the City of Waterloo, Black Hawk County,
Iowa.
3. That the City of Waterloo, Iowa, convey said parcel of
real property to Steven and Lori Harvey by Deed.
4 . That the Mayor and City Clerk are hereby authorized to
execute and deliver deed to Steven and Lori Harvey.
5. That the original of said deed fully executed and
acknowledged is hereby approved and confirmed by the Council.
6. That the City Clerk is authorized and directed to
deliver said deed of conveyance to Steven and Lori Harvey upon
receipt of the sum of $2, 000.00, and costs.
PASSED AND ADOPTED this 18th day of August, 2003.
