RESOLUTION NO. 2003-551 RESOLUTION FIXING THE TIME AND PLACE OF HEARING TO BE GIVEN ON APPLICATION OF CRAIG INDUSTRIES TO REZONE FROM "M-1" LIGHT INDUSTRIAL DISTRICT TO "M-2", "M-P" PLANNED HEAVY INDUSTRIAL DISTRICT PROPERTY GENERALLY LOCATED NORTHWEST OF THE INTERSECTION OF WEST SHAULIS ROAD AND HIGHWAY 63 FOR THE PURPOSE OF A SAND AND GRAVEL PIT AND STORAGE BUILDING FACILITY, AS SEPTEMBER 2, 2003, AT 5: 30 P.M. IN THE COUNCIL CHAMBERS IN CITY HALL AND INSTRUCTING CITY CLERK TO PUBLISH NOTICE OF HEARING. WHEREAS, the Council of the City of Waterloo, Iowa, shall meet in the Council Chambers in the City Hall in the City of Waterloo, Iowa, at 5: 30 p.m. on the 2nd day of September, 2003, for the purpose of considering and acting upon an application of Craig Industries to rezone from "M-1" Light Industrial District to "M-2", "M-P" Planned Heavy Industrial District property generally located northwest of the intersection of West Shaulis Road and Highway 63 for the purpose of a sand and gravel pit and storage building facility and legally described as follows: That part of the Southeast Quarter (SE ) of Section Twelve (12) , Township Eighty-eight North (T88N) , Range Fourteen West (R14W) of the Fifth Principal Meridian in Black Hawk County, Iowa, more particularly described as follows: Beginning at a point that is One Thousand Eight Hundred Thirteen and Six Tenths (1813. 6) feet Northeasterly of the South line of said Section 12, as measured on a line being One Thousand (1000) feet Northwesterly of and parallel to the Northwesterly right-of-way line of the Chicago and Northwestern Transportation Company' s Main Line from Chicago to Kansas City; thence Northeasterly, along that line described as being parallel to said Railroad' s Main Line right-of-way, to a point on the Southwesterly right-of-way line of said Railroad' s Cedar Falls Branch line; thence Southerly along the Southwesterly right- of-way line of said Branch Line to a point that is on a line normal to and passing through the point of beginning; thence Northwesterly to the point of beginning, containing 16. 19 acres, more or less, subject to all easements and encumbrances of record. AND That part of the South One-half of the Southeast Quarter of Section No. Twelve (12) , Township No. Eighty-eight (88) North, Range No. Fourteen (14) West of the Fifth Principal Meridian, Black Hawk County, Iowa, bounded as follows: Commencing at a point on the Northwesterly line of the Right of Way of the Waterloo Section of the Chicago Great Western Railroad which is Two Hundred (200) feet Northeasterly of the South line of said Section (as measured along said Right of Way line) ; thence Northwesterly at right angles with said Right of Way line a distance of Five Hundred (500) feet; thence Northeasterly at right angles a distance of Four Hundred Thirty-five and Six-tenths (435. 6) feet; thence Southeasterly at right angles a distance 0� g -551 (Wage cv Z t'.
