RESOLUTION NO. 2003-563
RESOLUTION GRANTING PERMISSION TO DIANNE
LAWLESS FOR A WAIVER FOR A CONCRETE DRIVEWAY
TO BE LOCATED AT 5055 HESS ROAD, AND
AUTHORIZING CONSTRUCTION OF A CONCRETE
DRIVEWAY, WITH THE ELIMINATION OF THE
SIDEWALK SECTION DUE TO THE INABILITY TO MEET
THE REQUIREMENTS OF THE DRIVEWAY AND SIDEWALK
POLICY, PARAGRAPH 1 AND PLACING A DRIVEWAY ON
CITY RIGHT-OF-WAY ON AN UNIMPROVED STREET.
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF WATERLOO, IOWA:
WHEREAS, the City Engineer has made written application to
the City Council asking that Dianne Lawless be authorized and
permitted to construct a concrete driveway, with the elimination
of the sidewalk section due to the inability to meet the
requirements of the driveway and sidewalk policy, Paragraph 1 and
placing a driveway on city right-of-way on an unimproved street to
Hess Road, and legally descr
ibed as follows :
be located at 5055

Parcel "C" of the Northwest 1/ Section 13 Township 88
North Range 13 West,
The South Three Hundred Thirty-two (332 . 00) feet in
even width of the West Three Hundred Ten (310) feet of
the North Five Hundred Ninety-seven (597 . 00) feet of
the Northwest Quarter (NW1/) of Section Thirteen (13) ,
Township Eighty-eight North (T88N) , Range Thirteen West
(R13W) of the Fifth Principal Meridian, City of
Waterloo, Black Hawk County, Iowa, except all highways
and except that part deeded to the City of Waterloo as
described in LD 568-945 in the Black Hawk County
Recorder' s Office . This Parcel "C" contains 1 . 689
acres, all in the City of Waterloo, Black Hawk County,
Iowa;
and
WHEREAS, it is the sense of the Council of the City of
Waterloo, Iowa, that said request should be granted.
NOW, THEREFORE, BE IT FURTHER RESOLVED that permission is
hereby granted to Dianne Lawless to construct a concrete driveway
subject to the following conditions :
1 . Work to be performed by an approved and bonded
contractor.
2 . A permit is to be obtained from the office of the City
Engineer prior to construction.
3 . All work shall be performed under the supervision of
the City Engineer and at no cost to the City of
Waterloo.
BE IT FURTHER RESOLVED that the City Clerk is authorized and
directed to forward a certified copy of this resolution to the
Black Hawk County Recorder for recording and the Black Hawk County
Auditor for filing in order that this said action may become a
matter of official County Record.
