RESOLUTION NO. 2003-604 RESOLUTION MAKING ASSESSMENT FOR REPAIRING THE PAVE BOX AND PREVENTION OF FURTHER DAMAGE AT 1003 LAFAYETTE STREET. WHEREAS, the Board of Water Works Trustees of the City of Waterloo, Iowa, did, as provided by law, notify by written notice the property owner of the premises known as 1003 Lafayette Street to have the pave box repaired and further damage prevented, and WHEREAS, the property owner failed to comply with the order of the Board of Water Works Trustees, as by law provided, and WHEREAS, the Board of Water Works Trustees proceeded to have the work done on the premises described as 1003 Lafayette Street, in the City of Waterloo, Iowa, to comply with Ordinance No. 1118 of the City of Waterloo, Iowa, and WHEREAS, the Board of Water Works Trustees filed with the City Clerk on the 28th day of August, 2003, a report filing claim for the repairing of the pave box and preventing further damage at above described premises and same met all the requirements of the City ordinance and have been fully completed. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF WATERLOO, IOWA, that the said report of the Board of Water Works Trustees be, and the same is hereby, approved; that the work was done under and by virtue hereby, accepted, and that the cost of said work is hereby determined to be as follows, which amount can be assessed over a ten-year period against the property: Mary Murray, Deed Holder Priscella Cunningham and Jessie Williams, Contract Purchasers 1003 Lafayette Street, Waterloo, Iowa Legal Description: Lots Nos. Seven (7) and Ten (10) excepting the Southeasterly Ninety-eight (98) feet of said Lots and also excepting the Northeasterly Thirty-five (35) feet of the Northwesterly fifty (50) feet of said Lot No. Seven (7) all in Block No. Twenty-four (24 ) , in the original Plat on the East Side of the Cedar River, all in the City of Waterloo, Black Hawk County, Iowa. RESOLUTION NO. 2003-605 RESOLUTION GRANTING PERMISSION TO LORI HEIDT- JOHNSON FOR A WAIVER FOR A CONCRETE DRIVEWAY TO BE LOCATED AT 119 BELLEVIEW ROAD, AND AUTHORIZING CONSTRUCTION OF A CONCRETE DRIVEWAY AND PLACING A DRIVEWAY OR SIDEWALK ON CITY RIGHT-OF-WAY ON AN UNIMPROVED STREET. BE IT RESOLVED BY THE COUNCIL OF THE CITY OF WATERLOO, IOWA: WHEREAS, the City Engineer has made written application to the City Council asking that Lori Heidt-Johnson be authorized and permitted to construct a concrete driveway and placing a driveway or sidewalk on City right-of-way on an unimproved street to be located at 119 Belleview Road, and legally described as follows: Prospect Circle Addition Lot 15, all in the City of Waterloo, Black Hawk County, Iowa; and WHEREAS, it is the sense of the Council of the City of Waterloo, Iowa, that said request should be granted. NOW, THEREFORE, BE IT FURTHER RESOLVED that permission is hereby granted to Lori Heidt-Johnson to construct a concrete driveway subject to the following conditions: 1 . Work to be performed by an approved and bonded contractor. 2. A permit is to be obtained from the office of the City Engineer prior to construction. 3. All work shall be performed under the supervision of the City Engineer and at no cost to the City of Waterloo. BE IT FURTHER RESOLVED that the City Clerk is authorized and directed to forward a certified copy of this resolution to the Black Hawk County Recorder for recording and the Black Hawk County Auditor for filing in order that this said action may become a matter of official County Record.
