RESOLUTION NO. 2003-725
RESOLUTION GRANTING REQUEST OF ALFRED AND
VIOLA HERBSLEB FOR A VARIANCE TO THE
SUBDIVISION ORDINANCE FOR FILING OF A MINOR
PLAT FOR PARCEL C AND PARCEL D IN THE
HERBSLEB DIVISION.
WHEREAS, Alfred and Viola Herbsleb have requested a
variance to filing of a Minor Plat for Parcel C and Parcel D,
plat of Survey Document No. 2004-01447, of Part of Lot 63,
Meadowdale Second Filing, Black Hawk County, Iowa, as required
by the Subdivision Ordinance, and
WHEREAS, the Subdivision Ordinance, Section 1 . 5, requires
that a subdivision, as defined, must go through the process of
the Planning, Programming and Zoning Commission and City Council
for approval, and
WHEREAS, the parcel to be divided in Herbsleb Subdivision
will create two lots in similar size to others in the area, and
WHEREAS, Section 1 . 14 (1) of the Subdivision Ordinance gives
the power for such variances to the Subdivision Ordinance to the
City Council, and
WHEREAS, the variances principles of the Subdivision
Ordinance state that the granting of such a variance shall not
work to secure the public interest and shall not have the effect
of nullifying the intent and purpose of the regulations, and
WHEREAS, the City Council finds the following:
1 . The granting of the variance will not be detrimental
to the public safety, health or welfare or injurious
to adjacent properties.
2. The conditions upon which the request for a variance
is based are unique to the property for which the
variance is sought and are not applicable generally to
other property.
3. Because of the particular physical surroundings, shape
or topographical conditions of the specific property
involved, particular hardship to the owner would
result, as distinguished from a mere inconvenience, if
the strict letter of these regulations are carried
out.
4 . The variance will not in any manner vary the
provisions of the Zoning Ordinance, Comprehensive Plan
or Official Street Plan.
