) Oo d BE IT RESOLVED BY THE COUNCIL OF THE CITY OF WATERLOO, IOWA,
v tW ` the Encroachment Agreement dated December 1, 2003 to allow
ctuction of a security fence on city-owned property generally
lotted on Gayle Street between Joy Drive and Rainbow Drive,
legLLy described as follows :

otrir-Encroachment Agreement upon the 30' wide right-of-way
4tknown as Gayle Drive that lies Southerly of the
Testerly extension of the Northerly line of Lot 11
triE-1 Clyde Miller Heights Second Subdivision and Northerly
E. , of a line drawn from the Southeast corner of Lot 7
flock 1 Clyde Miller Heights Addition in Castle Hill,
H O to the Southwest corner of Lot 8 Clyde Miller Heights
' Second Subdivision, now all a part of the City of
Waterloo, Black Hawk County, Iowa;
by and between Whitaker Foods, Inc . of Waterloo, Iowa, and the
City of Waterloo, Iowa, be and the same is hereby approved, and
the Mayor Pro Tem authorized to execute the same in behalf of the
City of Waterloo, Iowa.
PASSED AND ADOPTED this 1st day of December, 2003 .
