55 WHEREAS, the recreational trail along the north side of
Martin; ! Luther King Jr. Drive is non-compliance with Iowa
c;Department of Transportation specifications relating to
i_,sroothness, and
WHEREAS, Earth Tech, Inc. , the city' s consultant on said
project, has developed a corrective action which includes removal
and replacement of twenty-five (25) 10-foot sections of trail that
is non-compliance and considered defective work, and
WHEREAS, the corrective action also includes 1160 feet of
trail that is being considered as reasonably acceptable, and
WHEREAS, Earth Tech, Inc. derived a price adjustment based on
comparable price adjustments on other Iowa Department of
Transportation projects, and
WHEREAS, the total price adjustment of $7, 540. 00 was
calculated, and
WHEREAS, in lieu of the price adjustment, it is being
proposed that the contractor complete the initial construction of
a Trail Head near the Idaho Street intersection, and
WHEREAS, this work will include grading and earthwork of the
Trail Head as well as paving a driveway off of Idaho Street.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF
WATERLOO, IOWA, that the Corrective Action Agreement dated
February 25, 2002, in conjunction with Martin Luther King Jr.
Drive, Contract No. 556, by and between Petersen Contractors,
Inc. , Rampart Corporation, the Iowa Department of Transportation,
and the City of Waterloo, Iowa, be and the same is hereby
approved, and the Mayor authorized to execute the same in behalf
of the City of Waterloo, Iowa.
PASSED AND ADOPTED this 25th day of February, 2002.
