RESOLUTION NO. 2002-222 RESOLUTION REQUESTING A SPECIAL ELECTION TO AUTHORIZE THE IMPOSITION OF A NEW LOCAL OPTION SALES AND SERVICES TAX IN THE CITY OF WATERLOO, IOWA, AT THE RATE OF ONE PERCENT (1%) EFFECTIVE JANUARY 1, 2003, AND TO AUTHORIZE THE REPEAL OF THE EXISTING LOCAL OPTION SALES AND SERVICES TAX UPON SAID DATE. WHEREAS, Section 422B. 1 (3) of the Iowa Code provides that a city representing at least one half of the population of the county may, upon its own motion, request the county commissioner of elections to hold an election in the incorporated area of the city on the question of the imposition of a local sales and services tax revenues; and WHEREAS, this Council now wishes to request that an election be held and has determined the particulars of the proposed proposition to be as set forth below. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF WATERLOO, IOWA: Section 1 . That the County Commissioner of Elections for Black Hawk County, Iowa is hereby requested to call a special election on the imposition of a new local option sales and services tax within the City of Waterloo, Iowa and the repeal of the existing local option sales and services tax upon the effective date thereof. Section 2 . That the proposition substantially in the form attached hereto as Exhibit A be submitted to the voters. NOW, THEREFORE, BE IT FURTHER RESOLVED that the funds received from the local option sales and services tax be considered additional funds as allocated for the purposes set forth in the proposition attached hereto as Exhibit A and not as replacement funds for the present funding levels as authorized by the City Council of Waterloo, Iowa. BE IT FURTHER RESOLVED that the City Council of the City of Waterloo, Iowa, requests the Board of Supervisors of Black Hawk County to set the date of December 31, 2012 whereby the new tax would be repealed, without election. In order for the tax to be continued, another public referendum would have to be held prior to said termination date. Section 3. The City Clerk is hereby authorized and directed to file a certified copy of this resolution with the County Commissioner of Elections of Black Hawk County and with the Black Hawk County Board of Supervisors to request that the special election be scheduled for August 20, 2002. '003t: q-1k) local sales and services tax effective January 1, '11r 0 A ;-new local sales and services tax shall be imposed in the City of Waterloo, Iowa, at the rate of one percent (1%) , to be effective from January 1, 2003 until December 31, 2012, and the existing local sales and services tax shall be repealed effective January 1, 2003 . Revenues from the existing sales and services tax have been allocated as follows : Zero percent (0%) for property tax relief. One hundred percent (1000) for the reconstruction/repair/replacement of existing streets, curbs, structures, storm sewers, as they relate to the streets within the corporate limits of the City of Waterloo, Iowa. Revenues from the new sales and services tax are to be allocated as follows: Zero percent (0%) for property tax relief. Fifty percent (500) for the reconstruction/repair/replacement of existing streets, curbs, structures, storm sewers, as they relate to the streets within the corporate limits of the City of Waterloo, Iowa. Fifty percent (50%) for acquisition, construction, operation, and maintenance of project facilities and improvements undertaken as part of the amended Waterloo Riverfront Renaissance Plan, including but not limited to a recreation and sports complex, open-air art plaza and riverfront amphitheater, river walk trail, dam improvements to enhance river navigability, the establishment and maintenance of an endowment fund to aid in payment of operating expenses for project facilities, and the payment of principal and interest on bonds issued to finance such projects.
