RESOLUTION NO. 2002-630
RESOLUTION AUTHORIZING THE SALE AND
CONVEYANCE OF PROPERTY GENERALLY LOCATED NEAR
THE INTERSECTION OF ACKER AND ELDORA ROADS,
AND NORTHEAST AND SOUTHWEST OF THE RELOCATED
CREEK FOR $6, 315. 02, PLUS COSTS AND
AUTHORIZING THE MAYOR AND CITY CLERK TO
EXECUTE AND DELIVER A DEED FOR SAME.
WHEREAS, the City of Waterloo, Iowa, is the owner of real
property in the City of Waterloo, Iowa, as described below, and
WHEREAS, an offer to purchase said certain parcels of real
property in the sum of $6, 315. 02, plus costs, has been made by
Dale Rousselow, and
WHEREAS, a public hearing was held on October 21, 2002, at
5: 30 p.m. in the Council Chambers in City Hall, Waterloo, Iowa,
as provided by law, by the Council of the City of Waterloo, Iowa,
on the proposal to sell and convey premises owned by the City of
Waterloo, Iowa, to Dale Rousselow, Waterloo, Iowa, and
WHEREAS, it is the opinion of this Council that sale and
conveyance should be made as proposed.
NOW, THEREFORE, IT IS HEREBY RESOLVED BY THE COUNCIL OF THE
CITY OF WATERLOO, IOWA, AS FOLLOWS:
1 . The following described real property, as fully
described in the published notice in the Waterloo Courier on
October 9, 2002, is not presently needed and will not be needed
in the foreseeable future for municipal purposes and its
ownership is serving no municipal purpose, and
2 . That the offer of Dale Rousselow to purchase real
property for the sum of $6, 315 . 02 and costs be, and it is hereby
accepted for real property described below:
A parcel of land located in the Northeast of Section
13, Township 88 North, Range 14 West of the 5th
Principal Meridian, and the Northwest fractional y of
Section 18, Township 88 North, Range 13 West of the 5th
Principal Meridian, all in the City of Waterloo, Black
Hawk County, Iowa, more particularly described as
follows:
Commencing at the Northwest corner of the Northwest
fractional of said Section 18; thence South 00°00' 12"
East on the West line of the Northwest fractional of
said Section 18 a distance of 881 . 68 feet to the
present Southeasterly right-of-way line of Eldora Road,
the point of beginning of the parcel herein described;
thence North 24 °32' 57" East on the present
Southeasterly right-of-way line of Eldora Road a
distance of 79. 42 feet; thence North 46°38' 41" East on
the present Southeasterly right-of-way line of Eldora
Court a distance of 37 . 13 feet; thence South 00°00' 12"
East a distance of 540.22 feet; thence South 89°39' 16"
West a distance of 15. 08 feet; thence Northwesterly on
the present Northeasterly right-of-way line of Acker
Road and its extension Southeasterly being a 433 . 00-
foot radius curve concave Southwesterly and having a
267 . 64-foot long chord bearing North 32°34' 06" West a
distance of 272 . 09 feet (arc length) to the present

Southeasterly right-of-way line of Eldora Road; thence
North 24°32' 57" East on the present Southeasterly
right-of-way line of Eldora Road a distance of 238 . 60
feet to the point of beginning; containing 0 . 99 acre.
The above described parcel is subject to the following
described easement :
Commencing at the Northwest corner of the Northwest
fractional 1/ of said Section 18; thence South 00°00' 12"
East on the West line of the Northwest fractional of
said Section 18 a distance of 881 . 68 feet to the
present Southeasterly right-of-way line of Eldora Road;
thence South 24°32' 57" West on the present
Southeasterly right-of-way line of Eldora Road a
distance of 15. 48 feet to the point of beginning of the
parcel herein described; thence South 00°00' 12" East a
distance of 209. 90 feet; thence North 89°59' 48" East a
distance of 66. 43 feet; thence South 00°00' 12" East a
distance of 218 . 52 feet; thence South 89°39' 16" West a
distance of 15. 08 feet; thence Northwesterly on the
present Northeasterly right-of-way line of Acker Road
and its extension Southeasterly being a 433. 00-foot
radius curve concave Southwesterly and having a 267 . 64-
foot long chord bearing North 32°34' 06" West a distance
of 272 . 09 feet (arc length) to the present
Southeasterly right-of-way line of Eldora Road; thence
North 24 °32' 57" East on the present Southeasterly
right-of-way line of Eldora Road a distance of 223 . 12
feet to the point of beginning; containing 0 . 57 acre.
Basis of bearings: The West Line of the Northwest
fractional of said Section 18 is assumed to bear
South 00°00' 12" East for the purpose of this
description, all in the City of Waterloo, Black Hawk
County, Iowa;
and also;
A parcel of land located in the Northeast i of Section
18, Township 88 North, Range 13 West of the 5th
Principal Meridian, Waterloo, Black Hawk County, Iowa,
described as follows:
Commencing at the North quarter corner of said Section
18; thence South 00°14' 13" West on the West line of the
Northeast 1/ of said Section 18 a distance of 90 . 00 feet
to the point of beginning of the parcel herein
described; thence South 73°26' 56" East a distance of
527 . 41 feet; thence Southeasterly on a 288 . 88-foot
radius curve concave Southwesterly and having a 238 . 57-
foot long chord bearing South 50°59' 03" East a distance
of 245. 93 feet (arc length) ; thence North 00°03' 24"
East a distance of 299. 55 feet to a line that is 90 . 00
feet South of and parallel with the North line of the
Northeast of said Section 18; thence North 89°55' 34"
West on said line a distance of 691 . 21 feet to the
point of beginning; containing 75, 352 square feet, or
1 . 73 acres.
The North line of the Northeast of said Section 18 is
assumed to bear South 89°55' 34" East for the purpose of
this description, all in the City of Waterloo, Black
Hawk County, Iowa;

3 . That the City of Waterloo, Iowa, convey said parcels of
real property to Dale Rousselow by Deed.
4 . That the Mayor and City Clerk are hereby authorized to
execute and deliver deeds to Dale Rousselow.
5 . That the original of said deeds fully executed and
acknowledged is hereby approved and confirmed by the Council .
6. That the City Clerk is authorized and directed to
deliver said deeds of conveyance to Dale Rousselow upon receipt
of the sum of $6, 315 . 02, and costs .
