RESOLUTION NO. 2002-710 RESOLUTION AUTHORIZING THE CONVEYANCE OF PROPERTY FORMERLY KNOWN AS THE RATH PROPERTY TO CRYSTAL DISTRIBUTION SERVICES, INC. AND AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE AND DELIVER A DEED FOR SAME. WHEREAS, the City of Waterloo, Iowa, is the owner of real property in the City of Waterloo, Iowa, described below, and WHEREAS, by Resolution No. 1998-577 the City of Waterloo, Iowa, previously authorized the sale of said certain parcel of real property to Crystal Distribution Services, Inc. for the sum of $1 . 00, plus costs, and WHEREAS, said Resolution authorized the delivery of a deed, but the deed has not yet been delivered, and WHEREAS, due to changed circumstances since the time of the Council' s initial approval, it is necessary to modify the legal description to exclude a small portion of the parcel to be conveyed, and WHEREAS, Crystal Distribution Services, Inc. , has indicated that it is willing to accept conveyance of the modified parcel on the same terms as its initial agreement with the City of Waterloo, Iowa, and WHEREAS, it is the opinion of this Council that conveyance should be made as modified. NOW, THEREFORE, IT IS HEREBY RESOLVED BY THE COUNCIL OF THE CITY OF WATERLOO, IOWA, AS FOLLOWS : 1 . That the City Clerk is authorized and directed to deliver said deed of conveyance to Crystal Distribution Services, Inc. upon the receipt of the sum of $1 . 00, and costs.
