RESOLUTION NO. 2002-718
RESOLUTION AUTHORIZING THE SALE AND
CONVEYANCE OF RIGHT-OF-WAY GENERALLY LOCATED
AT THE SOUTHWEST CORNER OF BROADWAY STREET
AND WAGNER ROAD FOR PURPOSE OF CONSTRUCTING
NEW CORPORATE IDENTIFICATION SIGN FOR
$500 . 00 , PLUS COSTS AND AUTHORIZING THE MAYOR
AND CITY CLERK TO EXECUTE AND DELIVER A DEED
FOR SAME .
WHEREAS, the City of Waterloo, Iowa, is the owner of real
property in the City of Waterloo, Iowa, as described below, and
WHEREAS, an offer to purchase said certain parcel of real
property has been made by Cedar Valley Corporation in the sum of
$500 . 00, plus costs and,
WHEREAS, a public hearing was held on December 16, 2002 , at
5 : 30 p.m. in the Council Chambers in City Hall , Waterloo, Iowa,
as provided by law, by the Council of the City of Waterloo, Iowa,
on the proposal to sell and convey premises owned by the City of
Waterloo, Iowa, to Cedar Valley Corporation, and
WHEREAS, it is the opinion of this Council that sale and
conveyance should be made as proposed.
NOW, THEREFORE, IT IS HEREBY RESOLVED BY THE COUNCIL OF THE
CITY OF WATERLOO, IOWA, AS FOLLOWS :
1 . The following described real property, as fully
described in the published notice in the Waterloo Courier on
December 10, 2002 , is not presently needed and will not be needed
in the foreseeable future for municipal purposes and its
ownership is serving no municipal purpose, and
2 . That the offer of Cedar Valley Corporation to purchase
real property for the sum of $500 . 00 , plus costs, be, and it is
hereby accepted for real property described below:
A survey of Parcel "D" , excess right of way, in the
Northeast quarter (NE1/) , Section Nine (09) , Township
Eighty-Nine North (T89N) , Range Thirteen West (R13W) of
the Fifth Principal Meridian (5t'' P.M. ) , now a part of
the City of Waterloo, Black Hawk County, Iowa,
described as follows :
Commencing at the East Quarter of said Section; thence
N89°47' 55"W forty-six and twenty-two hundredths (46 . 22)
feet to the Iowa Department of Transportation right of
way rail found at the West line of Wagner Road, a
public right of way; thence N00°12 ' 05"E two hundred
twenty-five and no hundredths (225 . 00) feet along said
West line of Wagner Road, a public right of way to the
intersection with the southerly line of Broadway
Street, an Iowa Department of Transportation right of
way rail found, and the point of beginning of this
description; thence N62°05' 35"W one hundred sixty-seven
and twelve hundredths (167 . 12) feet along said
southerly line of Broadway Street ; thence S89°47' 55"E
seventy and twenty-six hundredths (70 . 26) feet; thence
Southeasterly one hundred twenty-two and five
hundredths (122 . 05) feet along a seventy-seven and
seventy-hundredths (77 . 70) foot radius curve, concave
Southwesterly, with a long chord bearing S44°47' 55"E
