RESOLUTION NO. 2001-55 RESOLUTION AUTHORIZING THE SALE AND CONVEYANCE OF PROPERTY GENERALLY LOCATED AT THE FORMER RATH PACKING SITE TO QUALITY MAT COMPANY FOR $1 . 00, PLUS COSTS AND AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE AND DELIVER A DEED FOR SAME. WHEREAS, the City of Waterloo, Iowa, is the owner of real property in the City of Waterloo, Iowa, as described below, and WHEREAS, an offer to purchase said certain parcel of real property in the sum of $1 . 00, plus costs, has been made by Quality Mat Company, and WHEREAS, a public hearing was held on February 19, 2001, at 5: 30 p.m. in the Council Chambers in City Hall, Waterloo, Iowa, as provided by law, by the Council of the City of Waterloo, Iowa, on the proposal to sell and convey premises owned by the City of Waterloo, Iowa, to Quality Mat Company, Waterloo, Iowa, and WHEREAS, it is the opinion of this Council that sale and conveyance should be made as proposed. NOW, THEREFORE, IT IS HEREBY RESOLVED BY THE COUNCIL OF THE CITY OF WATERLOO, IOWA, AS FOLLOWS: 1 . The following described real property, as fully described in the published notice in the Waterloo Courier on February 12, 2001, is not presently needed and will not be needed in the foreseeable future for municipal purposes and its ownership is serving no municipal purpose, and 2 . That the offer of Quality Mat Company to purchase real property for the sum of $1 . 00 and costs be, and it is hereby accepted for real property described below: That part of Parcel "C", as recorded in Misc. Book 330- 889, Black Hawk County Recorder' s Office, said part of Parcel "C" being a part of Auditor' s Morningside Plat and vacated Water Street, all in the City of Waterloo, Black Hawk County, Iowa, more particularly described as follows : Commencing at a point on the East line of Lot Nine (9) in said Auditor' s Morningside Plat which is Five Hundred Seventy and Nineteen Hundredths (570. 19) feet Southerly of the Northeast corner of Block Two (2) , Morningside Addition; thence North 71°47' 00" West Thirty-five (35. 00) feet to the point of beginning (said point being the most Easterly corner of said Parcel "C") ; thence continuing North 71°47' 00" West Two Hundred Five and Four Hundredths (205. 04) feet; thence South 43°23' East Forty-seven and Seventy-six Hundredths (47 . 76) feet; thence South 79°43' East One Hundred Sixty-four and Fifty-five Hundredths (164 .55) feet to the point of beginning, all in the City of Waterloo, Black Hawk County, Iowa. 3 . That the City of Waterloo, Iowa, convey said parcel of real property to Quality Mat Company by Deed. Resolution No . 2001-55 Page 2 4 . That the Mayor and City Clerk are hereby authorized to execute and deliver deed to Quality Mat Company. 5. That the original of said deed fully executed and acknowledged is hereby approved and confirmed by the Council . 6. That the City Clerk is authorized and directed to deliver said deed of conveyance to Quality Mat Company upon receipt of the sum of $1 . 00, and costs .
