RESOLUTION NO. 2001-81 RESOLUTION AUTHORIZING THE SALE AND CONVEYANCE OF 2 . 0 ACRES OF PROPERTY GENERALLY LOCATED SOUTH OF RANCHERO ROAD TO GENE AND MARCIA MEYER FOR $1, 000 . 00, PLUS COSTS AND 0 . 02 ACRES OF PROPERTY AND AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE AND DELIVER A DEED FOR SAME. WHEREAS, the City of Waterloo, Iowa, is the owner of real property in the City of Waterloo, Iowa, as described below, and WHEREAS, an offer to purchase said certain parcel of real property in the sum of for $1, 000. 00, plus costs and 0 . 02 acres of property, has been made by Gene and Marcia Meyer, and WHEREAS, a public hearing was held on March 12, 2001, at 5: 30 p.m. in the Council Chambers in City Hall, Waterloo, Iowa, as provided by law, by the Council of the City of Waterloo, Iowa, on the proposal to sell and convey premises owned by the City of Waterloo, Iowa, to Gene and Marcia Meyer, Waterloo, Iowa, and WHEREAS, it is the opinion of this Council that sale and conveyance should be made as proposed. NOW, THEREFORE, IT IS HEREBY RESOLVED BY THE COUNCIL OF THE CITY OF WATERLOO, IOWA, AS FOLLOWS: 1 . The following described real property, as fully described in the published notice in the Waterloo Courier on February 28, 2001, is not presently needed and will not be needed in the foreseeable future for municipal purposes and its ownership is serving no municipal purpose, and 2 . That the offer of Gene and Marcia Meyer to purchase real property for the sum of for $1, 000 . 00, plus costs and 0 . 02 acres of property be, and it is hereby accepted for real property described below: Part of the former Chicago and North Western Transportation Company right-of-way located in the Northwest and the Northeast , Section 12, Township 88 North, Range 14 West of the 5th Principal Meridian, Waterloo, Black Hawk County, Iowa, described as follows: Commencing at the Northwest corner of the Northeast 'K4 of said Section 12; thence South 00040' 33" East a distance of 33. 00 feet to a point on the present South right-of- way line of Ranchero Road, said point being the point of beginning of the parcel herein described; thence North 89°09' 55" East on the present South right-of-way line of Ranchero Road a distance of 52 . 53 feet to the point of intersection of the South right-of-way line of Ranchero Road with the Northeast right-of-way line of said former transportation company; thence South 46022' 49" East on the Northeast right-of-way line of said former transportation company a distance of 943. 30 feet to the Easterly line of parcel recorded in land deed book 571 page 502, Black Hawk County Recorder' s office; thence South 89007' 09" West on said Easterly line a distance of Resolution No . 2001-81 Page 2 85.78 feet; thence South 00040' 33" East on said Easterly line a distance of 55.71 feet to the intersection of said Easterly line with the Southwest right-of-way line of said former transportation company; thence North 46022' 49" West on the Southwest right-of-way line of said former transportation company a distance of 1023 . 01 feet to the present South right-of-way line of Ranchero Road; thence North 89011' 48" East on the present South right- of-way line of Ranchero Road a distance of 90. 31 feet to the point of beginning, all in the City of Waterloo, Black Hawk County, Iowa. The North line of the Northeast 11 of said Section 12 is assumed to bear North 89009' 55" East for the purpose of this description. Containing 95, 924 square feet or 2 .20 Acres. 3. That the City of Waterloo, Iowa, convey said parcel of real property to Gene and Marcia Meyer by Deed. 4 . That the Mayor and City Clerk are hereby authorized to execute and deliver deed to Gene and Marcia Meyer. 5. That the original of said deed fully executed and acknowledged is hereby approved and confirmed by the Council. 6. That the City Clerk is authorized and directed to deliver said deed of conveyance to Gene and Marcia Meyer upon receipt of the sum of for $1, 000 . 00, plus costs and 0 . 02 acres of property generally located south of Ranchero Road.
