RESOLUTION NO. 2001-84 RESOLUTION FIXING THE TIME AND PLACE OF HEARING TO BE GIVEN ON APPLICATION OF DICK KLINGAMAN TO REZONE FROM "C-2" COMMERCIAL DISTRICT TO "R-3,R-P" MULTIPLE PLANNED RESIDENTIAL DISTRICT PROPERTY GENERALLY LOCATED NORTHWESTERLY OF WEST FOURTH STREET BETWEEN WINGHAVEN DRIVE AND KIMPSTON CIRCLE, AS APRIL 2, 2001, AT 5: 30 P.M. IN THE COUNCIL CHAMBERS IN CITY HALL AND INSTRUCTING CITY CLERK TO PUBLISH NOTICE OF HEARING. WHEREAS, the Council of the City of Waterloo, Iowa, shall meet in the Council Chambers in the City Hall in the City of Waterloo, Iowa, at 5: 30 p.m. on the 2nd day of April, 2001, for the purpose of considering and acting upon an application of Dick Klingaman, upon the recommendation of approval of the City Planning, Programming & Zoning Commission to rezone from "C-2" Commercial District to "R- 3,R-P" Multiple Planned Residential District property generally located northwesterly of West Fourth Street between Winghaven Drive and Kimpston Circle to construct condominiums, and legally described as follows : That part of the East One-half (E ) of Section Seven (7) , Township Eighty-eight North (T88N) , Range Thirteen West (R13W) of the Fifth Principal Meridian, City of Waterloo, Black Hawk County, Iowa, described as follows : Beginning at the Southwesterly corner of Timberline Patio Homes Condominium; thence Westerly along the Southerly line of said Timberline Patio Homes extended, to a point which is Thirty (30) feet Northwesterly of and normally distant from the Southwesterly extension of the Northwesterly line of said Timberline Patio Homes; thence Southwesterly parallel with said Northwesterly line of Timberline Patio Homes Five Hundred Twenty-eight and Six Tenths (528 . 6) feet to a point which is Thirty (30) feet normally distant from and Northeasterly of a line drawn from the intersection point of the centerlines of U.S. Highway No. 63 and Ranchero Road to the intersection point of the centerlines of West Fourth Street and Winghaven Drive, said line being called the centerline of "Ranchero Road Extension"; thence Southeasterly Thirty (30) feet parallel with said "Ranchero Road Extension"; thence Northeasterly Five Hundred Fifty (550) feet to the point of beginning, containing 0. 37 acre, all in the City of Waterloo, Black Hawk County, Iowa. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF WATERLOO, IOWA, that the City Clerk is hereby directed to publish Notice of the time and place of said hearing in the Waterloo Courier.
