RESOLUTION NO. 2001-109 RESOLUTION APPROVING SITE PLAN AMENDMENT TO THE "R-3,R-P" MULTIPLE PLANNED RESIDENTIAL DISTRICT FOR PROPERTY GENERALLY LOCATED NORTHWESTERLY OF WEST FOURTH STREET BETWEEN WINGHAVEN DRIVE AND KIMPSTON CIRCLE TO CONSTRUCT CONDOMINIUMS. WHEREAS, it has been proposed that the Council of the City of Waterloo, Iowa, approve a site plan amendment to the "R-3,R-P" Multiple Planned Residential District for property generally located northwesterly of West Fourth Street between Winghaven Drive and Kimpston Circle to construct condominiums, and legally described as follow: That part of the East One-half (E ) of Section Seven (7) , Township Eighty-eight North (T88N) , Range Thirteen West (R13W) of the Fifth Principal Meridian, City of Waterloo, Black Hawk County, Iowa, described as follows: Beginning at the Southwesterly corner of Timberline Patio Homes Condominium; thence Westerly along the Southerly line of said Timberline Patio Homes extended, to a point which is Thirty (30) feet Northwesterly of and normally distant from the Southwesterly extension of the Northwesterly line of said Timberline Patio Homes; thence Southwesterly parallel with said Northwesterly line of Timberline Patio Homes Five Hundred Twenty-eight and Six Tenths (528 . 6) feet to a point which is Thirty (30) feet normally distant from and Northeasterly of a line drawn from the intersection point of the centerlines of U. S. Highway No. 63 and Ranchero Road to the intersection point of the centerlines of West Fourth Street and Winghaven Drive, said line being called the centerline of "Ranchero Road Extension"; thence Southeasterly Seven Hundred Seven and Sixth Tenths (707 . 6) feet parallel with said "Ranchero Road Extension" to the Northwesterly line of West Fourth Street; thence Northeasterly One Thousand Twenty and Four Tenths (1, 020.4) feet along said Northwesterly line to the Southeasterly corner of said Timberline Patio Homes; thence Westerly Eight Hundred Forty and Eight Tenths (840. 8) feet to the point of beginning, containing 12 .58 acres, all in the City of Waterloo, Black Hawk County, Iowa. WHEREAS, a public hearing was held on April 2, 2001, at 5: 30 p.m. at City Hall Council Chambers, Waterloo, Iowa, as provided by law, by the Council of the City of Waterloo, Iowa, on the proposal to approve said above mentioned site plan amendment, and WHEREAS, it is the opinion of this Council that said site plan amendment should be approved as proposed. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF WATERLOO, IOWA, that site plan amendment to the "R-3,R-P" Multiple Planned Residential District for property generally located northwesterly of West Fourth Street between Winghaven Drive and Kimpston Circle to construct condominiums, be and the same is hereby approved.
