RESOLUTION NO. 2001-129
RESOLUTION FIXING THE TIME AND PLACE OF
HEARING TO BE GIVEN ON THE REQUEST OF SCHENK
ENGINEERING ON BEHALF OF JOSEPH MINARD TO
REZONE FROM "A-1" AGRICULTURAL DISTRICT TO "R-
1" RESIDENTIAL DISTRICT, PROPERTY GENERALLY
LOCATED 1/ MILE EAST OF THE INTERSECTION OF
EAST SHAULIS ROAD AND HAMMOND AVENUE, AS MAY
7, 2001, AT 5: 30 P.M. IN THE COUNCIL CHAMBERS
IN CITY HALL AND INSTRUCTING CITY CLERK TO
PUBLISH NOTICE OF HEARING.
WHEREAS, the Council of the City of Waterloo, Iowa, shall meet
in the Council Chambers in the City Hall in the City of Waterloo,
Iowa, at 5: 30 p.m. on the 7th day of May, 2001, for the purpose of
considering and acting upon an on the request of Schenk Engineering
on behalf of Joseph Minard to rezone from "A-1" Agricultural
District to "R-1" Residential District, property generally located
14 mile east of the intersection of East Shaulis Road and Hammond
Avenue for residential development and legally described as
follows :
A part of the North of the NW 14 of Section 14-88-13,
Waterloo, Black Hawk County, Iowa, described as follows :
Commencing at the Northwest corner of the NW 14 of said
Section 14; thence South 89°54' 38" East along the North
line of the NW '4 of said Section 14 a distance of
1562 . 82 feet; thence South 00°26' 56" West a distance of
33. 00 feet to the point of beginning; thence South
89°54' 38" East parallel with and 33 . 00 feet normally
distant Southerly from the Northerly line of the NW 1/ of
said Section 14 a distance of 578 . 56 feet to the West
line of the East 15 acres of the North of the NW 14 of
said Section 14 which is also the West line of South
Fork Estates, Waterloo, Black Hawk County, Iowa; thence
South 00°11' 37" West along the West line of said South
Fork Estates a distance of 1293. 37 feet to the South
line of the North of the NW 1/ of said Section 14;
thence North 89°57' 09" West along the South line of the
North of the NW 1/ of said Section 14 a distance of
584 .33 feet; thence North 00°26' 56" East a distance of
1293 . 82 feet to the point of beginning;
and, also
A part of the North of the NW 1/ of Section 14-88-13,
Waterloo, Black Hawk County, Iowa, described as follows :
Commencing at the Northwest corner of the NW '4 of said
Section 14; thence South 89°54' 38" East along the North
line of the NW 1/ of said Section 14 a distance of 984 .36
feet to the point of beginning; thence South 00°42' 15"
West along the East line of the West 30 acres of the
North of the NW 1/ of said Section 14 a distance of
1327 .29 feet to the South line of the North ' of the NW
of said Section 14; thence South 89°57' 09" East along
the South line of the North of the NW 1/ of said
Section 14 a distance of 584 .42 feet; thence North
00°26' 56" East a distance of 1326. 82 feet to the North
line of the NW 1' of said Section 14; thence North
89°54' 38" West along the North line of the NW 1/ of said

beginning, except that part conveyed to Black Hawk
County by Warranty Deed in Land Deed Record 101, Page
419 of the records of said County, and also except that
part conveyed to the City of Waterloo by Warranty Deed
in Land Deed Record 539, Page 792 of the records of said
County, all in the City of Waterloo, Black Hawk County,
Iowa,.
The North line of the NW '' of Section 14-88-13,
Waterloo, Black Hawk County, Iowa, is assumed to bear
South 89°54' 38" East.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF
WATERLOO, IOWA, that the City Clerk is hereby directed to publish
Notice of the time and place of said hearing in the Waterloo
Courier.
