RESOLUTION NO. 2001-212 RESOLUTION AUTHORIZING THE SALE AND CONVEYANCE OF WESTERN AVENUE GENERALLY LOCATED BETWEEN WEST 5TH STREET AND JOHNSON AVENUE AND ALLEY GENERALLY LOCATED FROM WESTERN AVENUE SOUTHERLY TO JOHNSON STREET TO THE WATERLOO SCHOOL DISTRICT FOR $1 . 00, PLUS COSTS AND AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE AND DELIVER A DEED FOR SAME. WHEREAS, the City of Waterloo, Iowa, is the owner of real property in the City of Waterloo, Iowa, as described below, and WHEREAS, an offer to purchase said certain parcel of real property in the sum of $1 . 00, plus costs, has been made by the Waterloo School District, and WHEREAS, a public hearing was held on May 14, 2001, at 5: 30 p.m. in the Council Chambers in City Hall, Waterloo, Iowa, as provided by law, by the Council of the City of Waterloo, Iowa, on the proposal to sell and convey premises owned by the City of Waterloo, Iowa, to the Waterloo School District, and WHEREAS, it is the opinion of this Council that sale and conveyance should be made as proposed. NOW, THEREFORE, IT IS HEREBY RESOLVED BY THE COUNCIL OF THE CITY OF WATERLOO, IOWA, AS FOLLOWS: 1 . The following described real property, as fully described in the published notice in the Waterloo Courier on May 4, 2001, is not presently needed and will not be needed in the foreseeable future for municipal purposes and its ownership is serving no municipal purpose, and 2 . That the offer of the Waterloo School District to purchase real property for the sum of $1 . 00 and costs be, and it is hereby accepted for real property described below: Western Avenue from the Southeasterly right-of-way line of West Fifth Street Southerly to the Northerly right- of-way line of Johnson Street, Waterloo, Black Hawk County, Iowa. Beginning at the westerly corner of Lot 1, Block 6, Leavitt, Johnson and Miller' s Addition, Waterloo, Black Hawk County, Iowa; thence Southeasterly along the westerly line of said Block 6 a distance of 190. 80 feet; thence Southerly along the Westerly line of said Block 6 a distance of 97 . 70 feet to the Southwesterly corner of said Block 6; thence Westerly a distance of 80 . 00 feet to the Southeast corner of Lot 1, Wightman' s Subdivision, Waterloo, Black Hawk County, Iowa; thence Northerly along the Easterly line of Lots 1 and 2 of said Wightman' s Subdivision a distance of 69.50 feet; thence Northwesterly along the Northeasterly line of Lots 2, 3 and 4 of said Wightman' s Subdivision a distance of 164 . 70 feet to the Northerly corner of Lot 4, of said Wightman' s Subdivision; thence Northeasterly a distance of 80. 00 feet to the point of beginning, subject to City' s retention of utility easement over, Resolution No. 2001-212 Page 2 under and above the above described property, all in the City of Waterloo, Black Hawk County, Iowa; and, also 12 foot platted alley located in Wightman' s Subdivision, Waterloo, Black Hawk County, Iowa, from Western Avenue Southerly to Johnson Street. Beginning at the East corner of Lot 4, Wightman' s Subdivision, Waterloo, Black Hawk County, Iowa; thence Southwesterly along the Southeasterly line of Lots 4 and 5 of said Wightman' s Subdivision a distance of 80. 00 feet to the Southerly corner of said Lot 5; thence Southeasterly along the Easterly line of Lots 6 and 7 a distance of 90.7 feet to the Southeast corner of Lot 7 of said Wightman' s Subdivision which is also the Northerly line of Johnson Street; thence Easterly along the Northerly line of Johnson Street 12 feet more or less to the Southwest corner of Lot 1 of said Wightman' s Subdivision; thence Northwesterly along the Westerly line of Lots 1, 2 and 3 of said Wightman' s Subdivision a distance of 86. 00 feet to the Northwesterly corner of Lot 3 of said Wightman' s Subdivision; thence Northeasterly along the Northerly line of Lot 3 of said Wightman' s subdivision a distance of 72 . 00 feet to the Northerly corner of Lot 3 of said Wightman' s Subdivision which is also the Westerly line of Western Avenue; thence Northwesterly along the Westerly line of Western Avenue a distance of 12 . 00 feet to the point of beginning, all in the City of Waterloo, Black Hawk County, Iowa; 3. That the City of Waterloo, Iowa, convey said parcel of real property to the Waterloo School District by Deed. 4 . That the Mayor and City Clerk are hereby authorized to execute and deliver deed to the Waterloo School District. 5. That the original of said deed fully executed and acknowledged is hereby approved and confirmed by the Council. 6. That the City Clerk is authorized and directed to deliver said deed of conveyance to the Waterloo School District upon receipt of the sum of $1 . 00, and costs .
