This Resolution prepared by Nancy Eckert, City Clerk, 715 Mulberry Street, Waterloo, Iowa. RESOLUTION NO. 2001-473 RESOLUTION ACCEPTING AND APPROVING CERTAIN ACQUISITION CONTRACTS TO SELL REAL PROPERTY TO THE CITY AND ACCEPTING AND APPROVING CERTAIN DEED. WHEREAS, the City of Waterloo, Iowa, has had the parcel described herein appraised and the fair market value ascertained, and WHEREAS, the acquisition of the hereinafter described parcel is necessary to carry out the Iowa Brownfields Acquisition Project, NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF WATERLOO, IOWA, that the contract for the parcel hereinafter described to sell the same to the City of Waterloo, Iowa, all of which are situated in the City of Waterloo, Black Hawk County, Iowa, are accepted and approved and the Mayor and City Clerk are authorized and directed to execute the same in behalf of the City and to execute all instruments necessary to consummate the agreement to purchase the properties from the owners thereof, and the deed for the conveyance of the same are also accepted and approved and the City of Waterloo is directed to pay for the property and the incidental expenses necessary to the consummation of the sales from City funds. The subject parcels are: Chicago Central & Pacific Railroad, Company Acquisition-$55, 000. 00 Parcel No. 1 A part of fraction of land on the east bank of the Cedar River opposite Block Number 1, Original Plat on the East side of the Cedar River, Waterloo, Black Hawk County, Iowa and Water Street, described as follows: Beginning at the Southerly corner of said Block 1; thence South 44°14' 40" West along an extension of the Northwesterly line of East 7th Street a distance of 16. 50 feet; thence North 45°37' 36" West along the Northeasterly line of Water Street a distance of 97.72 feet to the Southwesterly line of said Block 1; thence North 55°12' 50" West along the Southwesterly line of Block 1 a distance of 36.25 feet to a point which is 30. 00 feet distant Southeasterly of existing railroad track; thence South 44°33' 39" West parallel with and 30.00 feet distant from said railroad track centerline a distance of 142.54 feet to the Northeasterly line of the Cedar River as established by the River Front Improvement Commission; thence South 66°28' 13" East along said Northeasterly line of the Cedar River a distance of 163. 84 feet; thence North 44°14' 40" East a distance of 26.31 feet; thence South 45°45' 20" East a distance of 61 .00 feet to the Southeasterly line of East 7th Street; thence North 44°14' 40" East along the Southeasterly line of East 7th Street a distance of 70.00 feet; thence North 38°15' 46" West a distance of 80.67 feet to the point of beginning, all in the City of Waterloo, Black Hawk County, Iowa.
