RESOLUTION NO. 2001-602 RESOLUTION AUTHORIZING THE SALE AND CONVEYANCE OF ALLEY GENERALLY LOCATED BETWEEN 646 AND 656 SUMMIT AVENUE TO RUSSEL D. REICHERTS FOR $1, 312 .00, PLUS COSTS AND AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE AND DELIVER A DEED FOR SAME. WHEREAS, the City of Waterloo, Iowa, is the owner of real property in the City of Waterloo, Iowa, as described below, and WHEREAS, an offer to purchase said certain parcel of real property in the sum of $1, 312. 00, plus costs, has been made by Russel D. Reicherts, and WHEREAS, a public hearing was held on November 5, 2001, at 5: 30 p.m. in the Council Chambers in City Hall, Waterloo, Iowa, as provided by law, by the Council of the City of Waterloo, Iowa, on the proposal to sell and convey premises owned by the City of Waterloo, Iowa, to Russel D. Reicherts, Waterloo, Iowa, and WHEREAS, it is the opinion of this Council that sale and conveyance should be made as proposed. NOW, THEREFORE, IT IS HEREBY RESOLVED BY THE COUNCIL OF THE CITY OF WATERLOO, IOWA, AS FOLLOWS: 1 . The following described real property, as fully described in the published notice in the Waterloo Courier on October 26, 2001, is not presently needed and will not be needed in the foreseeable future for municipal purposes and its ownership is serving no municipal purpose, and 2 . That the offer of Russel D. Reicherts to purchase real property for the sum of $1, 312. 00 and costs be, and it is hereby accepted for real property described below: Beginning at the Southeast corner of Lot 45 in Auditors Francis' West Side Plat in the City of Waterloo, in Black Hawk County, Iowa; thence North along the East line of said Lot 45 a distance of 148 . 8 feet; thence Northeasterly to a point on the West line of Lot 13 in Teeter' s Addition in the City of Waterloo, in Black Hawk County, Iowa which is 107 . 9 feet South of the Northwest corner of said Lot 13; thence south along the West line of said Lot 13 and that line extended to the West line of Lot 12 of said Teeter' s Addition, and along the West line of said Lot 12 to the Southwest corner of said Lot 12; thence West to the point of beginning, subject to the city' s retention of a permanent easement over, under and above the above described parcel, all in the City of Waterloo, Black Hawk County, Iowa. 3. That the City of Waterloo, Iowa, convey said parcels of real property to Russel D. Reicherts by Deed. 4 . That the Mayor and City Clerk are hereby authorized to execute and deliver deeds to Russel D.
