This Resolution prepared by Nancy Eckert, City Clerk, 715 Mulberry Street, Waterloo, Iowa. RESOLUTION NO. 2001-661 RESOLUTION AUTHORIZING THE SALE AND CONVEYANCE OF PROPERTY GENERALLY LOCATED AT THE FORMER RATH SITE TO QUALITY MAT COMPANY FOR $1 . 00, PLUS COSTS AND AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE AND DELIVER A DEED FOR SAME. WHEREAS, the City of Waterloo, Iowa, is the owner of real property in the City of Waterloo, Iowa, as described below, and WHEREAS, an offer to purchase said certain parcel of real property in the sum of $1. 00, plus costs, has been made by Quality Mat Company, and WHEREAS, a public hearing was held on December 10, 2001 at 5:30 p.m. in the Council Chambers in City Hall, Waterloo, Iowa, as provided by law, by the Council of the City of Waterloo, Iowa, on the proposal to sell and convey premises owned by the City of Waterloo, Iowa, to Quality Mat Company, Waterloo, Iowa, and WHEREAS, it is the opinion of this Council that sale and conveyance should be made as proposed. NOW, THEREFORE, IT IS HEREBY RESOLVED BY THE COUNCIL OF THE CITY OF WATERLOO, IOWA, AS FOLLOWS: 1. The following described real property, as fully described in the published notice in the Waterloo Courier; on November 28, 2001, is not presently needed and will not be needed in the foreseeable future for municipal purposes and its ownership is serving no municipal purpose, and 2. That the offer of Quality Mat Company to purchase real property for the sum of $1 . 00 and costs be, and it is hereby accepted for real property described below: That part of Parcel "C", as recorded in Misc. Book 330- 889, and all of Parcel "D" as recorded in Misc. Book 341-149, Black Hawk County Recorder' s Office, more particularly described as follows: Commencing at a point on the East line of Lot Nine (9) in said Auditor' s Morningside Plat which is Five Hundred Seventy and Nineteen Hundredths (570. 19) feet Southerly of the Northeast corner of Block Two (2) , Morningside Addition; thence North 71°47' 00" West Thirty-five (35. 00) feet to the point of beginning (said point being the mort Easterly corner of said Parcel "C") ; thence continuing North 71°47' 00" West Two Hundred Five and Four Hundredths (205. 04) feet; thence North 54°22' 15" West Four Hundred Six and Two Tenths (406. 20) feet to the most Westerly corner of Parcel "B" as recorded in Misc. Book 299-597; thence South 53°00' 30" East Four Hundred Fifty-three and Ninety-one Hundredths (453 . 91) feet; thence South 73°22' 25" East One Hundred Sixty-two and Ninety-three Hundredths (162 . 93) feet; thence North 18°13' 00" East Twenty (20 . 00) feet to the point of beginning, all in the City of Waterloo, Black Hawk County, Iowa. 3.
