RESOLUTION NO. 2000-12 RESOLUTION AUTHORIZING THE SALE AND CONVEYANCE OF A PORTION OF CRESTWOOD DRIVE GENERALLY LOCATED NORTHWEST OF LACKLAND DRIVE INTERSECTION TO GARY BERTCH AND STEVE AND SUE REITER FOR $1 . 00, PLUS COSTS AND AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE AND DELIVER SAID DEEDS FOR SAME . WHEREAS, the City of Waterloo, Iowa, is the owner of real property in the City of Waterloo, Iowa, as described below, and WHEREAS, an offer to purchase said certain parcels of real property in the sum of $1 . 00, plus costs, has been made by Gary Bertch and Steve and Sue Reiter, and WHEREAS, a public hearing was held on January 10, 2000, at 7 : 00 p.m. in the Council Chambers in City Hall, Waterloo, Iowa, as provided by law, by the Council of the City of Waterloo, Iowa, on the proposal to sell and convey premises owned by the City of Waterloo, Iowa, to Gary Bertch and Steve and Sue Reiter, and WHEREAS, it is the opinion of this Council that sale and conveyance should be made as proposed. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE COUNCIL OF THE CITY OF WATERLOO, IOWA, AS FOLLOWS : 1 . The following described real property, as fully described in the published notice in the Waterloo Courier on December 30, 1999, is not presently needed and will not be needed in the foreseeable future for municipal purposes and its ownership is serving no municipal purpose, and 2 . That the offer of Gary Bertch to purchase real property for the sum of $1 . 00 and costs be, and it is hereby accepted for real property described below: That part of vacated Crestwood Drive as platted in Cedar Crest, Waterloo, Black Hawk County, Iowa, described as follows : Beginning at the Northerly corner of Tract B, Cedar Crest; thence S 35°40' E along the Northeasterly line of said Tract B a distance of 340 . 21 feet; thence N 54°20' E a distance of 30 . 00 feet; thence N 35°40' W a distance of 340 . 21 feet; thence S 54°20' W a distance of 30 . 00 feet to the point of beginning and subject to city' s retention of a permanent easement over, under and above the Southeast 170 . 00 feet of said parcel, all in the City of Waterloo, Black Hawk County, Iowa . The Northeasterly line of Tract B is assumed to bear S 35°40' E; and also, that the offer of Steve and Sue Rieter to purchase real property for the sum of $1 . 00 and costs be, and it is hereby accepted for real property described below: Resolution No. 2000-12 Page 2 That part of vacated Crestwood Drive as platted in Cedar Crest, Waterloo, Black Hawk County, Iowa, described as follows : Commencing at the Northerly corner of Tract B, Cedar Crest; thence N 54°20' E a distance of 30 . 00 feet to the point of beginning; thence S 35°40' E a distance of 340 . 21 feet; thence N 54°20' E a distance of 30 . 00 feet to the Northeasterly right-of-way line of Crestwood Drive; thence N 35°40' W along said right-of-way line a distance of 340 . 21 feet; thence S 54°20' W a distance of 30 . 00 feet to the point of beginning, all in the City of Waterloo, Black Hawk County, Iowa . The Northeasterly right-of-way line of Crestwood Drive is assumed to bear N 35°40' W. 3 . That the City of Waterloo, Iowa, convey said parcels of real property to Gary Bertch and Steve and Sue Reiter by Deeds . 4 . That the Mayor and City Clerk are hereby authorized to execute and deliver deeds to Gary Bertch and Steve and Sue Reiter. 5 . That the original of said deeds fully executed and acknowledged is hereby approved and confirmed by the Council . 6. That the City Clerk is authorized and directed to deliver said deeds of conveyance to Gary Bertch and Steve and Sue Reiter upon receipt of the sum of $1 . 00, and costs .
