RESOLUTION NO. 2000-87
RESOLUTION ACCEPTING AND APPROVING CERTAIN
ACQUISITION CONTRACTS TO SELL REAL PROPERTY TO
THE CITY AND ACCEPTING AND APPROVING CERTAIN
DEED.
WHEREAS, the City of Waterloo, Iowa, has had the parcels
described herein appraised and the fair market value ascertained,
and
WHEREAS, the acquisition of the hereinafter described parcels
is necessary to carry out the Highway 218/Cedar Valley Lakes Trail-
Phase I, Contract No. 584,
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF WATERLOO, IOWA, that the contract for the parcels hereinafter
described to sell the same to the City of Waterloo, Iowa, all of
which are situated in the City of Waterloo, Black Hawk County,
Iowa, are accepted and approved and the Mayor and City Clerk are
authorized and directed to execute the same in behalf of the City
and to execute all instruments necessary to consummate the
agreement to purchase the property from the owners thereof, and the
deed for the conveyance of the same are also accepted and approved
and the City of Waterloo is directed to pay for the property and
the incidental expenses necessary to the consummation of the sale
from City funds .

City of Waterloo, Black Hawk County, Iowa, more
particularly described as follows:
Commencing at the Southeast corner of the Northeast 1/ of
the Northwest of Section 22, Township 89 North, Range
13 West of the Fifth Principal Meridian; thence West on
the South line of the Northeast of the Northwest 1/ of
said Section 22 a distance of 802 .30 feet; thence North
normal to the South line of the Northeast 1/ of the
Northwest 1/ of said Section 22 a distance of 23. 00 feet;
thence North 49°12' 00" East on the present Northwesterly
right-of-way line of Conger Street and its extension a
distance of 486.23 feet; thence North 56°23' 00" East on
the present Northwesterly right-of-way line of Conger
Street a distance of 44 . 72 feet; thence North 56°34' 00"
West a distance of 245. 72 feet; thence North 13°33' 00"
West a distance of 21 . 06 feet to the point of beginning
of the parcel herein described; thence continuing North

Basis of bearings: the present Northwesterly right-of-
way line of Conger Street is assumed to bear North
49°12' 00" East for the purpose of this description.

All that part of the Northeast 1/ of the Northwest 1/ of
Section 22, Township 89 North, Range 13 West of the
Fifth Principal Meridian, in the City of Waterloo, Black
Hawk County, Iowa, more particularly described as
follows:
Commencing at the Northeast corner of Lot 4, "Congress
Addition"; thence North 00°44' 56" West on the West
right-of-way line of Courier Street extended a distance
of 66. 00 feet to the former North right-of-way line of
Ansborough Avenue (formally Rainbow Drive) ; thence North
89°07' 34" East on the former North right-of-way line of
Ansborough Avenue (being 23. 00 feet North of and
parallel with the South line of the Northeast of the
Northwest of said Section 22) a distance of 386. 60
feet to the Southeast corner of the parcel acquired for
right-of-way as described in the Warranty Deed recorded
in Land Deed Book 555, Page 198, in the office of the
Recorder of Black Hawk County, Iowa, which point is the
point of beginning of the parcel herein described;

a point of the present North line of the parcel acquired
for right-of-way as described in the Warranty Deed

Avenue a distance of 71 . 63 feet; thence South 82°00' 01"
West on the present North right-of-way line of
Ansborough Avenue a distance of 80. 62 feet to the
original North right-of-way line of Ansborough Avenue;
thence South 89°07' 34" West a distance of 39. 67 feet to
the point of beginning; containing 2, 841 square feet,
all in the City of Waterloo, Black Hawk County, Iowa.
