RESOLUTION NO. 2000-114
RESOLUTION APPROVING APPLICATION WITH KEN
CAINES FOR TAX EXEMPTIONS ON IMPROVEMENTS
TOTALING $500, 000. 00 FOR PROPERTY LOCATED AT
2025 WESTFIELD AVENUE IN THE CONSOLIDATED
URBAN REVITALIZATION AREA PLAN, IN THE CITY OF
WATERLOO, BLACK HAWK COUNTY, IOWA.
WHEREAS, Ken Caines has submitted an application dated March
6, 2000 to the City Council of the City of Waterloo, Iowa,
requesting to receive tax exemption on improvements totaling
$500, 000.00 for property located at 2025 Westfield Avenue, more
fully described as follows:
That part of the Southeast Quarter of the Northwest
Quarter and of the Northeast Quarter of the Southwest
Quarter of Section No. 22, Township No. 89 North, Range
No. 13 West of the Fifth Principal Meridian, in the City
of Waterloo, Black Hawk County, Iowa, described as
follows:
Parcel A: Commencing at a point on the Northeasterly
line of the right of way of the Chicago, Rock Island &
Pacific Railroad, which point is 769. 7 feet Northwest of
the East line of the Northeast Quarter of the Southwest
Quarter of said Section No. 22 (measured along the
Northeasterly line of said right of way) ; thence North
along a line that is parallel with the said East line, a
distance of 382. 92 feet; to the Southwesterly line of
the right of way of the Waterloo, Cedar Falls & Northern
Railroad; thence Northwesterly along the Southwesterly
line of the right of way of the Waterloo, Cedar Falls &
Northern Railroad, a distance of 125 feet; thence at
right angles Southwesterly a distance of 12 . 05 feet;
thence Northwesterly along a line that is parallel with
the center line of the right of way of the Waterloo,
Cedar Falls & Northern Railroad a distance of 18 .7 feet;
thence at right angles Southwesterly a distance of 40. 95
feet; thence Southerly a distance of 411 .75 feet to a
point on the northeasterly line of the right of way of
the Chicago, Rock Island & Pacific Railroad, which point
is 130 feet Northwest of the point of beginning
(measured along the Northeasterly line of said right of
way) ; thence Southeasterly along the Northeasterly line
of said right of way a distance of 130 feet to the place
of beginning, all in the City of Waterloo, Black Hawk
County, Iowa;
and,
Parcel B: Beginning at a point on the Northeasterly
right of way line of the Chicago, Rock Island and
Pacific Railroad Company, said point being 899. 7 feet
Northwesterly from the intersection of said right of way
line with the North-South center line of said Section;
thence North 1°7' 45" East 411 .75 feet; thence North
69°57' 30" East 40. 95 feet, more or less, to a point that
is 30 feet Southwesterly from the center line of the
Waterloo Railroad Company main track as measured
radially; thence Northwesterly on a curve concave
Northeasterly, parallel with and 30 feet radial distance
Southwesterly of said main track center line to a point

289. 07 feet from the preceding point, as measured on a
line bearing North 9°15' 30" West from said preceding
point; thence North 2°24' 30" East parallel with and 30
feet perpendicular distance Southwesterly of said main
track center line 48 . 75 feet to a point 10 feet
Easterly, as measured radially, of the center line of
track No. 57 of said Waterloo Railroad Company; thence
Southwesterly on a curve concave Northwesterly parallel
with and 10 feet radial distance Southeasterly of said
track No. 57 center line 144 . 83 feet, as measured on a
line bearing South 32°11' 30" West from the preceding
point; thence South 40° West parallel with and 10 feet
Southeasterly of said track No. 57 center line and its
Southwesterly projection a distance of 440 feet, more or
less, to the Northeasterly right of way line of the
Chicago, Rock Island and Pacific Railroad Company;
thence Southeasterly along said right of way line to the
point of beginning, except that part conveyed to the
State of Iowa in 557 LD 141, all in the City of
Waterloo, Black Hawk County, Iowa;
and,
WHEREAS, said property is located within the designated
Consolidated Urban Revitalization Area in Waterloo, Iowa, as
previously established by the City Council of the City of Waterloo,
Iowa,
and,
WHEREAS, the improvement project respecting said property is
in conformance with the Consolidated Urban Revitalization Plan as
officially adopted by the City Council for the City of Waterloo,
Iowa, and
WHEREAS, the improvements on said property were made during
the time in which such improvements are eligible for the tax
exemption as set forth in the Consolidated Urban Revitalization
Plan as adopted by the City Council of the City of Waterloo, Iowa,
and as set forth in the Urban Revitalization Act as adopted by the
Legislature of the State of Iowa and signed by the Governor of the
State of Iowa, and
WHEREAS, said applicant is requesting the following exemption
schedule:
For the first year 800
For the second year 700
For the third year 600
For the fourth year 500
For the fifth year 400
For the sixth year 40o
For the seventh year 300
For the eighth year 300
For the ninth year 200
For the tenth year 200
NOW, THEREFORE, BE IT RESOLVED BY THE CITY OF COUNCIL OF THE
CITY OF WATERLOO, IOWA, that said application is hereby approved
and the City Clerk is hereby authorized and directed to forward
said application and a copy of this resolution to the Assessor by
February 1, 2001 .
