ORDINANCE NO. 5611
AN ORDINANCE APPROVING A REQUEST BY LOCKE
REALTY, INC., TO VACATE A UTILITY EASEMENT
ADJACENT TO THE KIMBALL AVENUE RIGHT-OF-WAY,
LOCATED AT 4140 KIMBALL AVENUE, IN THE "C-2,C-Z"
COMMERCIAL CONDITIONAL ZONING DISTRICT.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WATERLOO, IOWA
AS FOLLOWS:
Section 1. That the request by Locke Realty, Inc., to vacate a utility easement adjacent to
the Kimball Avenue right-of-way, located at 4140 Kimball Avenue, and legally described as
follows:
THAT PART OF THE NE 1/4 OF SECTION 9-88-13 IN THE CITY OF
WATERLOO, BLACK HAWK COUNTY, IOWA, DESC—IBED AS FOLLOWS:
COMMENCING AT THE NORTHEAST CORNER OF SAID NE 1/4 OF
SECTION 9-88-13; THENCE S. OO— 28' 22" E. ALONG THE EAST LINE OF
SAID NE 1/4 A DISTANCE OF 796.58 FEET; THENCE S. 89"" 31' 38" W. A
DISTANCE OF 60.00 FEET TO THE WESTERLY R-O-W LINE OF KIMBALL
AVENUE AND THE POINT OF BEGINNING; THENCE S. 32— 33' 04" W.
ALONG SAID WESTERLY R-O-W LINE A DISTANCE OF 91.78 FEET;
THENCE S. 01° 44' 18" W. ALONG SAID WESTE—LY R-O-W LINE A
DISTANCE OF 520.60 FEET TO THE NORTHERLY R-O-W LINE OF U.S. 20;
THENCE N. 12= 38' 24" E. A DISTANCE OF 176.78 FEET; THENCE N. 00= 28'
22" W. A DISTANCE OF 130.00 FEET; THENCE N. 05° 20' 02" E. A
DISTANCE OF 296.52 FEET TO THE POINT OF BEGINNING, EXCEPT THE
SOUTHERN 300 FEET OF THEREOF
shall be, and the same is hereby vacated.
