RESOLUTION NO. 2000-206 RESOLUTION FIXING THE TIME AND PLACE OF HEARING AND NOTICE TO BE GIVEN ON THE SALE AND CONVEYANCE OF VACATED LITCHFIELD AVENUE GENERALLY LOCATED BETWEEN DAVID AND COLUMBIA STREETS AS MAY 15, 2000, AT 5: 30 P.M. IN CITY HALL COUNCIL CHAMBERS, WATERLOO, IOWA AND INSTRUCTING THE CITY CLERK TO PUBLISH THE NOTICE OF HEARING. BE IT RESOLVED BY THE COUNCIL OF THE CITY OF WATERLOO, IOWA, AS FOLLOWS: Section 1 . That the Council of the City of Waterloo, Iowa shall meet at City Hall Council Chambers in the City of Waterloo, Iowa at 5: 30 p.m. on the 15th day of May, 2000, for the purpose of considering and acting upon a proposal to sell and convey a portion of vacated Litchfield Avenue generally located between David and Columbia Streets owned by the City of Waterloo, Iowa, to B. Schultz Company, and legally described as follows: A part of the Southwest Quarter of the Northeast Quarter of Section 14, Township 89 North, Range 13 West of the 5th Principal Meridian in Black Hawk County described as beginning at a point on the North line of Litchfield Avenue which is 707 . 5 feet South and 131 .2 feet West of the Northeast corner of the Southwest Quarter of the Northeast Quarter at said Section 14 and running thence West 546. 8 feet along the North line of Litchfield Avenue, thence South 29 feet to the South line of Litchfield Avenue, thence East 546. 8 feet along the South line of Litchfield Avenue, thence North 29 feet to the place of beginning, with the city' s retention of a utility easement over, under and above, the following described area: A part of the Southwest Quarter of the Northeast Quarter of Section 14, Township 89 North, Range 13 West of the 5th Principal Meridian in Black Hawk County described as beginning at a point on the North line of Litchfield Avenue which is 707 . 5 feet South and 131 .2 feet West of the Northeast corner of the Southwest Quarter of the Northeast Quarter of said Section 14 and running thence West 176 feet along the North line of Litchfield Avenue thence South 16 feet, thence East 176 feet, thence North 16 feet to the place of beginning, all in the City of Waterloo, Black Hawk County, Iowa; for $1, 585.72, plus costs, and also A part of the Southwest Quarter of the Northeast Quarter of Section 14, Township 89, Range 13 West of the 5th Principal Meridian in Black Hawk County described as follows : Beginning at the Northeast corner of Lot 10 Block 2 Litchfield First Addition, thence west along the North line of said lot 68 .2 feet, thence North 29 feet to the North line Litchfield Avenue, thence East along the North line of Litchfield Avenue to the westerly line of Columbia Street extended northerly, thence South 29 feet to the point of beginning, with the city' s retention of a permanent utility easement over, under and above, the following described parcel : Resolution No4 2000-206 Page 2 A part of the Southwest Quarter of the Northeast Quarter of Section 14, Township 89, Range 13 West of the 5th Principal Meridian in Black Hawk County described as follows: Commencing at the Northeast corner of Lot 10 Block 2 Litchfield First Addition, thence North along the Westerly line of Columbia Street extended Northerly a distance of 13 feet to the point of beginning, thence West 68 .2 feet, thence North 16 feet, thence East 68 .2 feet, thence South 16 feet to the point of beginning, all in the City of Waterloo, Black Hawk County, Iowa; for $2, 051 . 75, plus costs. Section 2 . That the City Clerk is hereby directed to publish notice of the time and place of said hearing in the Waterloo Courier. PASSED AND ADOPTED this 24th day of April, 2000. ohn R.
