RESOLUTION NO. 2000-655 RESOLUTION AUTHORIZING THE SALE AND CONVEYANCE OF PROPERTY GENERALLY LOCATED AT THE NORTHWEST CORNER OF WEST 4TH STREET AND SHAULIS ROAD TO WENDELL LUPKES FOR $1, 100. 00, PLUS COSTS AND AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE AND DELIVER A DEED FOR SAME. WHEREAS, the City of Waterloo, Iowa, is the owner of real property in the City of Waterloo, Iowa, as described below, and WHEREAS, an offer to purchase said certain parcel of real property in the sum of $1, 100. 00, plus costs, has been made by Wendell Lupkes, and WHEREAS, a public hearing was held on December 11, 2000, at 5: 30 p.m. in the Council Chambers in City Hall, Waterloo, Iowa, as provided by law, by the Council of the City of Waterloo, Iowa, on the proposal to sell and convey premises owned by the City of Waterloo, Iowa, to Wendell Lupkes, Waterloo, Iowa, and WHEREAS, it is the opinion of this Council that sale and conveyance should be made as proposed. NOW, THEREFORE, IT IS HEREBY RESOLVED BY THE COUNCIL OF THE CITY OF WATERLOO, IOWA, AS FOLLOWS: 1 . The following described real property, as fully described in the published notice in the Waterloo Courier on November 29, 2000, is not presently needed and will not be needed in the foreseeable future for municipal purposes and its ownership is serving no municipal purpose, and A parcel of land located in the Southeast 1/ of the Southwest fractional 1/ and the Southwest of the Southeast of Section 7, Township 88 North, Range 13 West of the Fifth Principal Meridian, Waterloo, Black Hawk County, Iowa, more particularly described as follows: Commencing at the Southeast corner of the Southwest fractional of said Section 7; thence North 89°30' 48" West on the South line of the Southwest fractional 1/ of said Section 7 a distance of 407 . 06 feet; thence North 00°27' 28" West a distance of 34 .35 feet to the former Northwesterly right-of-way line of West Fourth Street; thence Northeasterly on the former Northwesterly right- of-way line of West Fourth Street being a 444 .46-foot radius curve concave Northwesterly and having a 299.27- foot long chord bearing North 65°39' 36" East a distance of 305.23 feet (arc length) to the point of beginning of the parcel herein described; thence continuing Northeasterly on the former Northwesterly right-of-way line of West Fourth Street being a 444 . 46-foot radius curve concave Northwesterly and having a 130.39-foot long chord bearing North 37°33' 06" East a distance of 130. 86 feet (arc length) ; thence North 29°07' 02" East on the former Northwesterly right-of-way line of West Fourth Street a distance of 295. 57 feet; thence South 00°19' 36" East a distance of 363 .51 feet; thence North 89°30' 48" West on a line which is 160. 00 feet normally distant North of and parallel with the South line of the Southwest fractional of said Section 7 a distance of Resolution No. 2000-655 Page 2 225. 37 feet to the point of beginning, subject to the city' s retention of a permanent utility easement over the Northwesterly 20. 00 feet in even width of the above- described property; containing 37, 714 square feet, all in the City of Waterloo, Black Hawk County, Iowa. The South line of the Southwest fractional of said Section 7 is assumed to bear North 89°30' 48" West for the purpose of this description. 2 . That the offer of Wendell Lupkes to purchase real property for the sum of $1, 100. 00 and costs be, and it is hereby accepted for real property described below: 3. That the City of Waterloo, Iowa, convey said parcel of real property to Wendell Lupkes by Deed. 4 . That the Mayor and City Clerk are hereby authorized to execute and deliver deed to Wendell Lupkes . 5. That the original of said deed fully executed and acknowledged is hereby approved and confirmed by the Council. 6. That the City Clerk is authorized and directed to deliver said deed of conveyance to Wendell Lupkes upon receipt of the sum of $1, 100 . 00, and costs .
