RESOLUTION NO. 2000-676
RESOLUTION ACCEPTING AND APPROVING CERTAIN
PARTIAL ACQUISITION CONTRACT TO SELL REAL
PROPERTY TO THE CITY AND ACCEPTING AND
APPROVING CERTAIN DEED.
WHEREAS, the City of Waterloo, Iowa, has had the parcel
described herein appraised and the fair market value ascertained,
and
WHEREAS, the acquisition of the hereinafter described parcel
is necessary to carry out the Cedar Prairie/Sergeant Road Trail,
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF WATERLOO, IOWA, that the contract for the parcel hereinafter
described to sell the same to the City of Waterloo, Iowa, all of
which is situated in the City of Waterloo, Black Hawk County, Iowa,
is accepted and approved and the Mayor and City Clerk are
authorized and directed to execute the same in behalf of the City
and to execute all instruments necessary to consummate the
agreement to purchase the property from the owners thereof, and the
deed for the conveyance of the same is also accepted and approved
and the City of Waterloo is directed to pay for the property and
the incidental expenses necessary to the consummation of the sale
from City funds.

A parcel of land located in the Southwest 1/ of the
Southeast 14 and the Southeast of the Southeast 1,1, all
in Section 1, Township 88 North, Range 14 West of the
Fifth Principal Meridian, Black Hawk County, Iowa, more
particularly described as follows :
Commencing at the Southeast corner of said Section 1;
thence South 89°09' 55" West (assumed bearing for the
purpose of this description) on the South line of the
Southeast of said Section 1 a distance of 1, 280. 00
feet (1, 280 . 00 feet record) to the point of beginning of
the parcel herein described; thence continuing South
89°09' 55" West on the South line of the Southeast 1/ of
said Section 1 a distance of 212 . 61 feet; thence North
65°03' 15" East a distance of 308 .71 feet; thence South
27°54' 37" West a distance of 143. 84 feet to the point of
beginning, by survey containing 13, 406 square feet, or
0 . 31 acre, all in the City of Waterloo, Black Hawk
County, Iowa.
