RESOLUTION NO. 2000-677 RESOLUTION ACCEPTING AND APPROVING CERTAIN PARTIAL ACQUISITION CONTRACT TO SELL REAL PROPERTY TO THE CITY AND ACCEPTING AND APPROVING CERTAIN DEED. WHEREAS, the City of Waterloo, Iowa, has had the parcel described herein appraised and the fair market value ascertained, and WHEREAS, the acquisition of the hereinafter described parcel is necessary to carry out the Cedar Prairie/Sergeant Road Trail . NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF WATERLOO, IOWA, that the contract for the parcel hereinafter described to sell the same to the City of Waterloo, Iowa, all of which is situated in the City of Waterloo, Black Hawk County, Iowa, is accepted and approved and the Mayor and City Clerk are authorized and directed to execute the same in behalf of the City and to execute all instruments necessary to consummate the agreement to purchase the property from the owners thereof, and the deed for the conveyance of the same is also accepted and approved and the City of Waterloo is directed to pay for the property and the incidental expenses necessary to the consummation of the sale from City funds. The subject parcel is : Parcel No. 881412201001 Gene A. and Marcia M. Meyer, Owner Partial Acquisition A parcel of land located in the Northeast of the Northwest of the Northeast k of Section 12, Township 88 North, Range 14 West of the Fifth Principal Meridian, Black Hawk County, Iowa, more particularly described as follows : Commencing at the Northwest corner of the Northeast of said Section 12; thence North 89°09' 55" East (assumed bearing for the purpose of this description) on the North line of the Northeast of said Section 12 a distance of 657 . 87 feet to the Northwest corner of the Northeast 3,1 of the Northwest of the Northeast 1/ of said Section 12; thence South 00°42' 04" East on the West line of the Northeast 1,1 of the Northwest 1/ of the Northeast 1/ of said Section 12 a distance of 330. 92 feet to the point of intersection of said West line and the South line of the North of the Northeast 14 of the Northwest of the Northeast of said Section 12; thence North 89°09' 13" East on said South line a distance of 329. 01 feet (333. 00 feet record) ; thence South 21°06' 32" West a distance of 8 . 63 feet to the present South right-of-way line of Ranchero Road, the point of beginning of the parcel of land herein described; thence continuing South 21°06' 32" West a distance of 51 .47 feet; thence North 17°12' 34" West a distance of 49.75 feet to the present South right-of-way line of Ranchero Road; thepce North 89°09' 13" East on the present South rig ,t-Qt”way line of Ranchero Road a distance of 33 .26 feet tile point of beginning, by survey containing 794 square feet, or 0 . 02 acre, all in the Resolution No . 2000-677 Page 2 City of Waterloo, Black Hawk County, Iowa.
