RESOLUTION FIXING THE TIME AND PLACE OF
HEARING TO BE GIVEN ON APPLICATION OF
CLAASSEN ENGINEERING ON BEHALF OF ALABAR
PLAZA INC. AND ESTER HESS TO REZONE FROM "A-
1" AGRICULTURAL DISTRICT TO "M-1" LIGHT
INDUSTRIAL DISTRICT PROPERTY GENERALLY
LOCATED AT THE- NORTHEAST INTERSECTION OF HESS
AND EAST SHAULIS ROADS, AS FEBRUARY 8, 1999,
AT 7 : 00 P.M. IN THE COUNCIL CHAMBERS IN CITY
HALL AND INSTRUCTING CITY CLERK TO PUBLISH
NOTICE OF HEARING.
WHEREAS, the Council of the City of Waterloo, Iowa, shall
meet in the Council Chambers in theh City Hall in the City of
Waterloo, Iowa, at 7 : 00 p.m. on the 8 day of February, 1999, for
the purpose of considering and acting upon an application of
Claassen Engineering on behalf of Alabar Plaza Inc. and Ester Hess
to rezone from "A-1" Agricultural District to "M-1" Light
Industrial District property generally located at the northeast
intersection of Hess and East Shaulis Roads for the proposed
development of warehousing and industrial facilities, and legally
described as follows:
A parcel of land located in part of the Southwest 1/ and
part of the Southeast 1/ of Section 12 , Township 88
North, Range 13 West of the 5tn PM, Black Hawk County,
Iowa, described as follows :
Commencing at the West 1A Corner said Section 12 ; thence
S00°05' 15" E, 1, 315 .29 feet along the West line of the
Southwest 1/ said Section 12 ; thence N 89°45' 45" E,
1, 320 . 35 feet along an existing fence, thence
continuing along said fence N 89°22 ' 43" E, 379 . 65 feet
to the point of beginning; thence N 89°22 ' 43" E, along
said fence 940 . 7 feet; thence continuing along said
fence N 89°18' 42" E, 661 . 85 feet to the Westerly right
of way line of relocated Primary Road U.S . 218 ; thence
N 43°25' 30" W, 506 . 11 feet along said right of way line;
thence N 43°32 ' 20" W, 1, 034 . 07 feet along said right of
way line; thence N 41°18' 36" W, 256 . 03 feet along said
right of way line to the North line of the Southwest 1/
said Section 12 ; thence S 89°23 ' 38" W, 2, 015 .31 feet
along said North line to the Easterly right of way line
of Hess Road; thence S 00°05' 15" E, 700 feet along said
Easterly right of way line; thence N 89°23 ' 38" E, 1, 640
feet; thence S 00°05' 15" E to the point of beginning,
all in the City of Waterloo, Black Hawk County, Iowa.
The South One-half (SM) of the Southwest Quarter (SW %)
of Section 12 , Township 88 North, Range 13 West of the
5th PM, Black Hawk County, Iowa, except the West 1, 700
feet thereof and excepting roadways, all in the City of
Waterloo, Black Hawk County, Iowa.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF
WATERLOO, IOWA, that the City Clerk is hereby directed to publish
notice of the time and place of said hearing in the Waterloo
Courier.
