RESOLUTION NO. 1999-30
RESOLUTION AUTHORIZING THE SALE AND
CONVEYANCE OF PROPERTY LOCATED AT 235
BALTIMORE STREET TO JIMMIE JONES FOR
$7, 000 . 00, PLUS COSTS, AND AUTHORIZING THE
MAYOR AND CITY CLERK TO EXECUTE AND DELIVER
DEED FOR SAME.
WHEREAS, the City owns certain real property located at 235
Baltimore Street, Waterloo, Iowa, legally described as :
The Northwesterly 40 feet of Lot No. 17 in Block No. 4
in Whitney and Sedgwick' s Addition, all in the City of
Waterloo, Black Hawk County, Iowa;
WHEREAS, Jimmie L. Jones previously offered to purchase from
the City said property for the price of $7, 000 . 00 ; and
WHEREAS, the City accepted this offer in Resolution No. 1987-
668, but was unable to convey clear title to Jones thereafter; and
WHEREAS, as an interim measure to preserve Jones' rights in
the property pending resolution of title problems, the City and
Jones entered into a Lease Agreement with Option to Purchase,
dated May 15, 1989; and
WHEREAS, Jones has paid all monies due pursuant to the offer
and acceptance contract between the parties and pursuant to the
Lease Agreement, and the City acknowledges receipt of said monies;
and
WHEREAS, a public hearing on the proposal to complete the
sale and conveyance of the property was held on January 25, 1999,
after due notice of said hearing was published in accordance with
applicable law; and
WHEREAS, The City in now able to provide clear title and
desires to consummate the transaction with Jones; and
WHEREAS, sale of the property will generate funds to be used
to enhance law enforcement in the City of Waterloo or in the State
of Iowa.
NOW, THEREFORE, IT IS HEREBY RESOLVED BY THE COUNCIL OF THE
CITY OF WATERLOO, IOWA, AS FOLLOWS :
1 . The real property owned by the City of Waterloo, Iowa,
located at 235 Baltimore Street, Waterloo, Iowa, and legally
described as :
The Northwesterly 40 feet of Lot No. 17 in Block No. 4
in Whitney and Sedgwick' s Addition, all in the City of
Waterloo, Black Hawk County, Iowa;
is not presently needed and will not be needed in the foreseeable
future for municipal purposes, and its ownership is serving no
municipal purpose.
2 . That the offer of Jimmie L. Jones to purchase said real
property for the sum of $7, 000 . 00 is hereby accepted and approved.

3 . That the Mayor and City Clerk are authorized and directed
to convey said property to Jimmie L. Jones by executing and
delivering to Jimmie L. Jones a quit claim deed, and to execute
and deliver the deed as soon as is reasonably possible.
4 . That the prior actions taken by city personnel with
respect to the sale and/or lease of this property to Jimmie L.
Jones are hereby ratified and approved.
