RESOLUTION NO. 1999-53
RESOLUTION FIXING THE TIME AND PLACE OF
HEARING TO BE GIVEN ON APPLICATION OF
AUTOZONE AUTO PARTS STORE TO DEDICATE THIRTY-
ONE (31) FEET OF RIGHT-OF-WAY GENERALLY
LOCATED ALONG THE SOUTHERN PORTION OF ESTHER
STREET AND TWENTY (20) FEET GENERALLY LOCATED
ALONG THE WESTERN EDGE OF SHERMAN AVENUE, AS
FEBRUARY 22, 1999, AT 7 : 00 P.M. IN THE
COUNCIL CHAMBERS IN CITY HALL AND INSTRUCTING
CITY CLERK TO PUBLISH NOTICE OF HEARING.
WHEREAS, the Council of the City of Waterloo, Iowa, shall
meet in the Council Chambers in the City Hall in the City of
Waterloo, Iowa, at 7 : 00 p.m. on the 22nd day of February, 1999,
for the purpose of considering and acting upon an application of
AutoZone Auto Parts Store to dedicate thirty-one (31) feet of
right-of-way generally located along the southern portion of
Esther Street and twenty (20) feet generally located along the
western edge of Sherman Avenue, and legally described as follows :
Part of the Southwest Quarter of the Northwest Quarter
of Section 13, Township 89 North, Range 13 West of the
Fifth Principal Meridian, described as follows :
Commencing at the Southwest Corner of said Southwest
Quarter of the Northwest Quarter of Section 13; thence
North 0°31' 07" West, 125. 68 feet; thence North
89°28' 53" East, 35. 08 feet to the easterly right of way
line of Logan Avenue (U. S. Highway 63) ; thence North
1°20' 35" West, 180 . 98 feet on said right of way line to
the existing southerly right of way line of Ester
Street and the POINT OF BEGINNING; thence North
89°22' 21" East, 628 . 61 feet on said right of way line to
the existing westerly right of way line of Sherman
Avenue; thence South 0°33' 10" East, 31 . 00 feet on said
right of way line; thence South 89°22' 21" West, 628 . 19
feet, parallel with and 31 . 00 feet southerly of the
existing right of way line of Esther Street, to the
easterly right of way line of Logan Avenue; thence
North 0°20' 35" East, 31. 00 feet on said right of way
line to the point of beginning, containing 0. 418 acres,
all in the City of Waterloo, Black Hawk County, Iowa.

Quarter of the Northwest Quarter of Section 13; thence

East, 35. 08 feet to the easterly right of way line of
Logan Avenue (U. S. Highway 63) ; thence North 89°25' 45"
East, 625. 12 feet to the westerly right of way line of
Sherman Avenue and the POINT OF BEGINNING; thence South
89°25' 45" West, 19. 00 feet; thence North 0°33' 10" West,
150. 57 feet, 19. 00 feet westerly of and parallel with
the existing right of way line of Sherman Avenue to a
point 31. 00 feet South of the existing right of way
line of Ester Street; thence North 89°22' 21" East, 20. 00
feet, 31 feet southerly of and parallel with said

Sherman Avenue; thence South 0°33' 10" East, 165 . 59 feet
on said right of way line; thence South 89°25' 45" West,
1 . 00 feet on said right of way line; thence South
0°33' 10" East, 16. 00 feet on said right of way line to
the point of beginning, containing 0 . 064 acres, all in
the City of Waterloo, Black Hawk County, Iowa.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF
WATERLOO, IOWA, that the City Clerk is hereby directed to publish
notice of the time and place of said hearing in the Waterloo
Courier.
