RESOLUTION NO. 1999-68 RESOLUTION FIXING THE TIME AND PLACE OF HEARING AND NOTICE TO BE GIVEN ON THE SALE AND CONVEYANCE OF THE PARCEL OF LAND GENERALLY LOCATED BEHIND NORTHLAND OIL LOCATED AT 1000 RAINBOW DRIVE, TO NORTHLAND OIL FOR $1 . 00 PLUS COSTS, AND DEDICATION OF AN EASEMENT TO NORTHLAND OIL FOR PROPERTY GENERALLY LOCATED BEHIND 1000 RAINBOW DRIVE, AS MARCH 8 , 1999, AT 7 : 00 P.M. IN CITY HALL COUNCIL CHAMBERS, WATERLOO, IOWA AND INSTRUCTING THE CITY CLERK TO PUBLISH THE NOTICE OF HEARING. BE IT RESOLVED BY THE COUNCIL OF THE CITY OF WATERLOO, IOWA, AS FOLLOWS : Section 1 . That the Council of the City of Waterloo, Iowa shall meet at City Hall Council Chambers in the City of Waterloo, Iowa at 7 : 00 p.m. on the 8th day of March, 1999, for the purpose of considering and acting upon a proposal to sell and convey a parcel of land generally located behind Northland Oil located at 1000 Rainbow Drive, to Northland Oil, and legally described as follows : That part of Lots One (1) , Two (2) and Three (3) , Sherwood Park, a sub-division in Sections No. Sixteen (16) and Twenty-one (21) , Township No. Eighty-nine (8 9) North, Range No. Thirteen (13) West of the fifth Principal Meridian in Black Hawk County, Iowa, and that part of vacated Fairbanks Drive and also that part of the former WCF&N RR right--of-way described as follows : Commencing at a point on the Northeast line of said Lot Two (2) which is Seventy (70) feet Northwesterly from the Northeast corner of said Lot Two (2) ; thence Southwesterly normal to the Northeasterly line of said Lot Two (2) a distance of Sixty (60) feet; thence Southwesterly Eighty (80) feet to the point of beginning, along a line, which line, if extended Southwesterly would intersect the Southwesterly line of said Lot Three (3) , at a point Seventy (70) feet Northwesterly form the Southeasterly corner of said Lot Three (3) ; thence Southeasterly Ninety-two and Eighty- four Hundredths (92 . 84) feet along a line, which if extended Southeasterly, intersects the Southeast line of said Lot Two (2) at One Hundred Fifty-five (155) feet Southwesterly from the Northeast corner of said Lot Two (2) ; thence deflect left 150°02 ' 40" Thirty-four and Seventeen Hundredths (34 . 17) feet ; thence deflect left 31°57' 10" Eighty-four and Nine Hundredths (84 . 09) feet; thence deflect left. 69°52 ' 15" One Hundred Sixty- one and Twenty-one Hundredths (161 . 21) feet; thence deflect left 4°31' 55" Eighty and Seven Tenths (80 . 70) feet to a point on the Northerly extension of the West line of Lot Nine (9) , Auditor' s Whitney Road Plat in Sections 16 and 21-89-13 ; thence southerly Twenty-four and Two Hundredths (24 . 02 ) feet along said extension to the most Northerly corner of said Lot Nine (9) ; thence Northeasterly to a point on the Southwesterly line of said Lot Three (3) which is Seventy (70) feet Northwesterly of the most Southerly corner of said Lot Three (3) ; thence N41°05' 50" E forty-seven and Two Tenths (47 . 2) feet ; thence N74°38' 20" E One Hundred Twenty-two and Forty-two Hundredths (122 . 42) feet to the point of beginning. Resolution 1999-68 Page 2 Also that part of Lot One (1) in said Sherwood Park described as beginning at a point on the Northwesterly line of said Lot One (1) which is Twenty-five (25) feet Northeasterly of the Southwest corner of said Lot One (1) ; thence Northeasterly Thirty-five and Thirty-three Hundredths (35 . 33) feet along said Northwesterly line; thence Southeasterly Fifty-one and One Tenth (51 . 10) feet to a point on the South line of said Lot One (1) which is Forty-one and Seventy-eight Hundredths (41 . 78) feet East of the Southwest corner of said Lot One (1) ; thence West Eleven and Seventy-eight Hundredths (11 . 78) feet along said South line; thence Northwesterly Twenty-six and Forty-five Hundredths (26 .45) feet to the point of beginning, all in the City of Waterloo, Black Hawk County, Iowa; for $1 . 00, plus costs; and also, dedicate to Northland Oil an easement for property generally located behind their current business located at 1000 Rainbow Drive, described as follows : An easement Ten (10) feet in width, crossing a point of the former Waterloo, Cedar Falls and Northern Railroad right-of-wy, part of vacated Fairbanks Drive and part of Lots Two (2) and Three (3) in Sherwood Park, a sub- division in Sections No. Sixteen (16) and Twenty-one (21) , Township No. Eighty-nine (89) North, Range No. Thirteen (13) West of the Fifth Principal Meridian in Black Hawk County, Iowa, the Southeasterly line of said Ten (10) foot strip being described as follows; Beginning at a point on the Northerly extension of the Westerly line of Lot Nine (9) , Auditor' s Whitney Road Plat in Section 16 and 21-89-13 , said point being Twenty-four and Two Hundredths (24 . 02) feet North of the most Northerly corner of said Lot Nine (9) thence deflect right from said Northerly extension 61°42 ' 15" Eighty and Seven Tenths (80 . 7) feet; thence deflect right 4°31' 55" One Hundred Sixty-one and Twenty-one Hundredths (161 . 21) feet to the point of termination of said line . The Ten (10) foot strip is bounded on the West by the Northerly extension of the West line said Lot Nine (9) and on the East by a line which deflects left, from the last course described at the point of termination, 110°07' 45" , all in the City of Waterloo, Black Hawk County, Iowa. Section 2 . That the City Clerk is hereby directed to publish notice of the time and place of said hearing in the Waterloo Courier. PASSED AND ADOPTED this 15th day of February, 1999 .
