RESOLUTION NO. 1999-183 RESOLUTION ACCEPTING AND APPROVING PARTIAL ACQUISITION CONTRACT TO SELL REAL PROPERTY TO THE CITY AND ACCEPTING AND APPROVING CERTAIN DEED. WHEREAS, the City of Waterloo, Iowa, has had the parcel described herein appraised and the fair market value ascertained, and NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF WATERLOO, IOWA, that the contract for the parcel hereinafter described to sell the same to the City of Waterloo, Iowa, all of which is situated in the City of Waterloo, Black Hawk County, Iowa, is accepted and approved and the Mayor and City Clerk are authorized and directed to execute the same in behalf of the City and to execute all instruments necessary to consummate the agreement to purchase the property from the owner thereof, and the deed for the conveyance of the same are also accepted and approved and the City of Waterloo is directed to pay for the property and the incidental expenses necessary to the consummation of the sale from City funds. The subject parcels are: Parcel No. 101 Arlene M. De Wall, Owner Partial Acquistion-$11, 900 . 00 A parcel of land located in the Southeast A of the Southwest % of Section 20, Township 89 North, Range 12 West of the Fifth Principal Meridian, in the City of Waterloo, Black Hawk County, Iowa, more particularly described as follows : Commencing at the Southwest corner of said Section 20; thence North 89°32 ' 32" East on the South line of the Southwest % of said Section 20 a distance of 1, 367. 50 feet; thence North 00°41 ' 58" West a distance of 33 . 00 feet to the present Northerly right-of-way line of Independence Avenue, the point of beginning of the parcel herein described; thence continuing North 00°41 ' 58" West a distance of 957 . 00 feet to a point which is 1, 367. 90 feet East of the West line of the Southwest A of said Section 20 (as measured parallel with the South line of the Southwest % of said Section 20) ; thence North 89°32 ' 32" East a distance of 176 . 00 feet; thence South 00°41 ' 58" East a distance of 137 . 28 feet; thence Southwesterly on a 641 . 20-foot radius curve concave Southeasterly and having a 291 . 39-foot long chord bearing South 23°58 ' 37" West a distance of 293 . 96 feet (arc length) ; thence South 00°38 ' 10" West a distance of 127.27 feet; thence South 08°11 '45" West a distance of 98 . 09 feet; thence South 00°36 ' 12" East a distance of 330 . 21 feet to the present Northerly right- of-way line of Independence Avenue; thence South 89°32 ' 32" West on the present Northerly right-of-way line of Independence Avenue a distance of 35 . 66 feet to the point of beginning; containing 1 . 71 acres, all in the City of Waterloo, Black Hawk County, Iowa.
