RESOLUTION NO. 1999-265 RESOLUTION AUTHORIZING THE SALE AND CONVEYANCE OF THE RIGHT-OF-WAY GENERALLY LOCATED ON THE NORTH AND SOUTH SIDE OF LOGAN AVENUE AT THE MULLAN AVENUE INTERSECTION TO THE SALVATION ARMY FOR $1 . 00, PLUS COSTS, AND AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE AND DELIVER DEED FOR SAME. WHEREAS, the City of Waterloo, Iowa, is the owner of real property in the City of Waterloo, Iowa, as described below, and WHEREAS, an offer to purchase said certain parcels of real property in the sum of $1 . 00, plus costs, has been made by the Salvation Army, and WHEREAS, a public hearing was held on April 26, 1999, at 7 : 00 p.m. in the Council Chambers in City Hall, Waterloo, Iowa, as provided by law, by the Council of the City of Waterloo, Iowa, on the proposal to sell and convey premises owned by the City of Waterloo, Iowa, to the Salvation Army, and WHEREAS, it is the opinion of this Council that sale and conveyance should be made as proposed. NOW, THEREFORE, IT IS HEREBY RESOLVED BY THE COUNCIL OF THE CITY OF WATERLOO, IOWA, AS FOLLOWS : 1 . The following described real property, as fully described in the published notice in the Waterloo Courier on April 19, 1999, is not presently needed and will not be needed in the foreseeable future for municipal purposes and its ownership is serving no municipal purpose, and 2 . That the offer of the Salvation Army to purchase real property for the sum of $1 . 00, and costs, be and it is hereby accepted for real property described below: That part of Lots Nine (9) and Ten (10) , Block Sixty- five (65) , Cooley Addition, Waterloo, Black Hawk County, Iowa, described as follows : Beginning at the Northwest corner of Lot Ten (10) in said Block Sixty-five (65) ; thence East along the North line of said Lot Ten (10) to point which is Thirty-five (35) feet West of the Northeast corner of said Lot Ten (10) ; thence Southwesterly to a point on the South line of said Lot Ten (10) which is Fifty-eight and Sixty-six Hundredths (58 . 66) feet East of the Southwest corner of said Lot Ten (10) ; thence continuing Southwesterly along the last described course a distance of Twenty- one and Sixty-seven Hundredths (21 . 67) feet; thence Northwesterly Forty-four and Twenty-eight Hundredths (44 .28) feet to a point on the South line of said Lot Ten (10) which is Six and Nineteen Hundredths (6. 19) feet East of the Southwest corner of said Lot Ten (10) ; thence continuing Northwesterly along the last described course Thirty-five Hundredths (0 . 35) feet; thence Northwesterly Eight and Eighty-three Hundredths (8 . 83) feet to a point on the West line of said Lot Ten (10) which is Six and Fifty-seven Hundredths (6 . 57) feet North of the Southwest corner of said Lot Ten Resolution 1999-265 Page 2 (10) ; thence North to the point of beginning; And also; That part of Logan Avenue adjoining Auditor Rainbow' s Replat, City of Waterloo, Black Hawk County, Iowa, described as follows : • Beginning at a point on the East line of Lot Four (4) in said Auditor Rainbow' s Replat which is Twenty-three and Three Tenths (23 . 3) feet South of the Northeast corner of said Lot Four (4) ; thence N 0°00' 00" E along the West line of said Logan Avenue One Hundred Sixty- two and Thirteen Hundredths (162 . 13) feet; thence S 14°48' 00" E Forty-three and Fifty-seven Hundredths (43 .57) feet; thence S 43°22' 30" E Thirty-three and Eighty-eight Hundredths (33 . 88) feet; thence S 62°22' 30" E Thirty-four and Sixty-seven Hundredths (43 . 67) feet; thence S 2°33' 45" E Eighteen and Sixteen Hundredths (18 . 16) feet; thence S 47°08' 30" W Eighty-nine and Ninety-four Hundredths (89 . 94) feet to the point of beginning, all in the City of Waterloo, Black Hawk County, Iowa; 3 . That the City of Waterloo, Iowa, convey said parcels of real property to the Salvation Army by Deed. 4 . That the Mayor and City Clerk are hereby authorized to execute and deliver deed to the Salvation Army. 5 . That the original of said deed fully executed and acknowledged is hereby approved and confirmed by the Council . 6 . That the City Clerk is authorized and directed to deliver said deed of conveyance to the Salvation Army upon receipt of the sum of $1 . 00, and costs .
