RESOLUTION NO. 1999-300 RESOLUTION APPROVING RELEASE OF REAL ESTATE MORTGAGE FOR ROGER DAY, 7844 KIMBALL AVENUE, FOR PAYMENT OF PROMISSORY NOTE IN CONJUNCTION WITH THE KIMBALL SOUTH RURAL WATER MAIN PROJECT AND DIRECTING EXECUTION OF SAID RELEASE OF REAL ESTATE MORTGAGE BY MAYOR PRO TEM. WHEREAS, Roger Day, 7844 Kimball Avenue, has paid the Waterloo Water Works the remaining balance of the Promissory Note and Mortgage in conjunction with the Kimball South Rural Water Main Project for the following described property: The North Three Hundred Forty-one and Three Tenths (341 . 3) feet of the South Seven Hundred Sixty-nine and Three Tenths (769 . 3) feet of the West Three Hundred Seventy-three (373 . 0) feet of the East Four Hundred Twenty-three (423 . 0) feet of the Southeast Quarter (SE1-) of the Southeast Quarter (SE11) of Section Twenty-eight (28) , Township Eighty-eight (88) North, Range Thirteen (13) West of the Fifth Principal Meridian, all in the City of Waterloo, Black Hawk County, Iowa. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF WATERLOO, IOWA, that the Release of Real Estate Mortgage dated May 3, 1999, for payment of Promissory Note in conjunction with the Kimball South Rural Water Main Project, by and between Roger Day, 7844 Kimball Avenue, and the City of Waterloo, Iowa, be and the same is hereby approved and the Mayor Pro Tem authorized to execute the same in behalf of the City of Waterloo, Iowa.
