RESOLUTION NO. 1999-465
RESOLUTION ACCEPTING AND APPROVING CERTAIN
ACQUISITION CONTRACT TO SELL REAL PROPERTY TO
THE CITY AND ACCEPTING AND APPROVING CERTAIN
DEED.
WHEREAS, the City of Waterloo, Iowa, has had all the parcel
described herein appraised and the fair market value ascertained,
and
WHEREAS, the acquisition of the hereinafter described parcel
is necessary to carry out the Martin Luther King Jr. Drive/Bishop
Avenue Extension Project,
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF WATERLOO, IOWA, that the contract for the parcel
hereinafter described to sell the same to the City of Waterloo,
Iowa, all of which is situated in the City of Waterloo, Black Hawk
County, Iowa, is accepted and approved and the Mayor and City
Clerk are authorized and directed to execute the same in behalf of
the City and to execute all instruments necessary to consummate
the agreement to purchase the property from the owners thereof,
and the deed for the conveyance of the same is also accepted and
approved and the City of Waterloo is directed to pay for the
property and the incidental expenses necessary to the consummation
of the sale from City funds .
The subject parcels are :

A parcel of land located in the Northeast % of the
Southeast % of Section 21, Township 89 North, Range 12
West of the Fifth Principal Meridian, Black Hawk
County, Iowa, more particularly described as follows :
Commencing at the Northeast corner of the Southeast 1/
of said Section 21; thence South 00°52 ' 54" East on the
East line of the Southeast % of said Section 21 a
distance of 639 . 64 feet; thence South 89°07 ' 07" West a
distance of 60 . 00 feet to the present Westerly right-
of-way line of North Elk Run Road, the point of
beginning of the parcel herein described; thence South
89°49 ' 47" West a distance of 539 .20 feet; thence
Northwesterly on a 2, 646 .48-foot radius curve concave
Northeasterly and having a 728 .38-foot long chord
