RESOLUTION NO. 1999-474 RESOLUTION FIXING THE TIME AND PLACE OF HEARING AND NOTICE TO BE GIVEN ON THE VACATION, SALE AND CONVEYANCE OF A PORTION OF FORRESTER AVENUE GENERALLY LOCATED NORTH OF RAINBOW DRIVE AND SOUTH OF HIGHWAY 218 SOUTHBOUND TO NORTHLAND OIL CO. FOR $1 . 00, PLUS COSTS, AS AUGUST 9, 1999, AT 7 : 00 P.M. IN CITY HALL COUNCIL CHAMBERS, WATERLOO, IOWA AND INSTRUCTING THE CITY CLERK TO PUBLISH THE NOTICE OF HEARING. BE IT RESOLVED BY THE COUNCIL OF THE CITY OF WATERLOO, IOWA, AS FOLLOWS : Section 1 . That the Council of the City of Waterloo, Iowa shall meet at City Hall Council Chambers in the City of Waterloo, Iowa at 7 : 00 p.m. on the 9th day of August, 1999, for the purpose of considering and acting upon a proposal to vacate, sell and convey a portion of Forrester Avenue generally located north of Rainbow Drive and south of Highway 218 southbound to Northland Oil Co. for expansion of their facility, and legally described as follows : That part of the forty-eight foot (48' ) wide Forester Avenue right-of-way (also known as Forrester Avenue) that lies North of a line drawn from the Southeasterly corner of Lot 5 Auditor' s Whitney Road Plat to the Southwest corner of Lot 8 Pattison' s Subdivision and South of the extension Easterly of the North line of vacated Fairbanks Drive, subject to the city' s retention of a permanent utility easement over, under and above the above described property, all in the City of Waterloo, Black Hawk County, Iowa; for $1 . 00, plus costs . Section 2 . That the City Clerk is hereby directed to publish notice of the time and place of said hearing in the Waterloo Courier. PASSED AND ADOPTED this 19th day of July, 1999 . John R.
