RESOLUTION NO. 1999-476
RESOLUTION OF THE CITY COUNCIL OF WATERLOO,
IOWA, WAIVING THE REQUIREMENT TO FILE A
SUBDIVISION PLAT AND ACCOMPANYING DOCUMENTS
WITHIN NINE (9) MONTHS FROM THE DATE OF CITY
COUNCIL APPROVAL; AND RATIFYING ITS PRIOR
APPROVAL.
WHEREAS, on July 27 , 1998 , the City Council of the City of
Waterloo, Iowa, approved the Final Plat of Tower Park 2 , a/k/a
Tower Park No. 2 , pursuant to Resolution No . 1998-487 ; and
WHEREAS, Section 2 . 4 (2) (a) of the Subdivision Ordinance of
the City of Waterloo prescribes that a subdivision plat approved
by this Council be filed with the county recorder during a time
not to exceed nine (9) months from the date of such approval ; and
WHEREAS, as a result of inadvertence, the Final Plat and
accompanying documents of Tower Park 2 , a/k/a Tower Park No. 2 ,
were not filed with the county recorder during prescribed period;
and
WHEREAS, there have been no changes in the Final Plat or
accompanying documents since the same were approved by this
Council and the Final Plat and accompanying documents comply with
the requirements of the City of Waterloo Subdivision Ordinance .
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF WATERLOO, IOWA, that the terms of the Waterloo
Subdivision Ordinance requiring that the Final Plat and
accompanying documents be filed with the county recorder during a
period not to exceed nine (9) months from the date of approval by
this Council are hereby waived with respect to Tower Park 2 ,
a/k/a Tower Park No. 2 ; that the action taken July 27, 1998, as
Resolution 1998-487 , is hereby ratified and approved; and the
Mayor and City Clerk are hereby authorized and directed to
certify and affix their signatures to said resolution.
PASSED AND ADOPTED this 19th day of July, 1999 .
