RESOLUTION NO. 2021-611 RESOLUTION APPROVING A REQUEST BY THE CITY OF WATERLOO TO DEDICATE 21,464 SQUARE FEET OF CITY OWNED PROPERTY AS RIGHT-OF-WAY THAT CURRENTLY SERVES AS COMMERCIAL STREET, LOCATED ADJACENT TO 2314 COMMERCIAL STREET. BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF WATERLOO, IOWA, that the following described property that currently serves as Commercial Street, located adjacent to 2314 Commercial Street and legally described as follows: AN AREA FOR RIGHT-OF-WAY PURPOSES OVER, UNDER AND ACROSS THAT PART OF THE SOUTHEAST QUARTER (SE 1/4) OF SECTION TWENTY-FIVE (25), TOWNSHIP EIGHTY-NINE NORTH (T89N), RANGE THIRTEEN WEST (R13W), OF THE FIFTH PRINCIPAL MERIDIAN, WATERLOO, BLACK HAWK COUNTY, IOWA, DESCRIBED AS FOLLOWS: COMMENCING AT THE NORTHEAST CORNER OF EAST PARCEL IN MISCELLANEOUS BOOK 338, PAGE 206 IN THE BLACK HAWK COUNTY RECORDER'S OFFICE; THENCE N88°32'50"E FOURTEEN AND TWENTY HUNDREDTHS (14.20) FEET LONG THE NORTH LINE OF LOT ONE (01), ROOFFS ADDITION TO THE EAST LINE OF FRONT STREET AS PER SOUTH WATERLOO AND TO THE POINT OF BEGINNING; THENCE CONTINUE N88°32'50"E ONE HUNDRED TWENTY-FIVE AND NINETY- FIVE HUNDREDTHS (125.95) FEET STILL ALONG SAID NORTH LINE TO THE NORTHEAST CORNER OF SAID LOT ONE (01); THENCE CONTINUE N88°32'50"E NINETY-ONE AND NINETY-NINE HUNDREDTHS (91.99) FEET ALONG THE NORTH LINE OF PARCEL "F", DOCUMENT NO. 2021- 22316 IN AFORESAID RECORDER'S OFFICE TO THE NORTHEAST CORNER OF SAID PARCEL "F"; THENCE CONTINUE N88°32'50"E ONE HUNDRED FORTY-THREE AND NINETY-SEVEN HUNDREDTHS (143.97) FEET ALONG THE SOUTH LINE OF AFORESAID SOUTHEAST QUARTER (SE 1/4) TO THE NORTHEAST CORNER OF PARCEL #11, CITY LOT DEED 660, PAGE 555 IN AFORESAID RECORDER'S OFFICE; THENCE NO2°34'22"W FIFTY-NINE AND FORTY HUNDREDTHS (59.40) FEET ALONG THE NORTHERLY EXTENSION OF THE EAST LINE OF SAID PARCEL #11 TO THE EASTERLY EXTENSION OF THE SOUTH LINE OF LOT THIRTY-NINE (39), AFORESAID SOUTH WATERLOO; THENCE S88°32'50"W THREE HUNDRED SIXTY AND SEVENTY-EIGHT HUNDREDTHS (360.78) FEET ALONG SAID EASTERLY EXTENSION TO THE SOUTHEAST CORNER OF SAID LOT THIRTY-NINE (39); THENCE S02°34'22"E FIFTY-NINE AND FORTY HUNDREDTHS (59.40) FEET ALONG AFORESAID EAST EAST LINE OF FRONT STREET TO THE POINT OF BEGINNING CONTAINING 21,464 SQUARE FEET. be and the same is hereby dedicated as 21,464 square feet of right-of-way.
