RESOLUTION NO. 1999-606 RESOLUTION FIXING THE TIME AND PLACE OF HEARING AND NOTICE TO BE GIVEN ON THE VACATION, SALE AND CONVEYANCE OF THE EAST- WEST ALLEY GENERALLY LOCATED WESTERLY OF EAST 4TH STREET BETWEEN MOSLEY AND RICKER STREETS TO DEVERA SUTHERLAND AND JEROME AND LEODA AMOS, AS SEPTEMBER 20, 1999, AT 7 : 00 P.M. IN CITY HALL COUNCIL CHAMBERS, WATERLOO, IOWA AND INSTRUCTING THE CITY CLERK TO PUBLISH THE NOTICE OF HEARING. BE IT RESOLVED BY THE COUNCIL OF THE CITY OF WATERLOO, IOWA, AS FOLLOWS: Section 1 . That the Council of the City of Waterloo, Iowa shall meet at City Hall Council Chambers in the City of Waterloo, Iowa at 7 : 00 p.m. on the 20th day of September, 1999, for the purpose of considering and acting upon a proposal to vacate the east-west alley generally located westerly of East 4th Street between Mosley and Ricker Streets, legally described as follows: The east-west 10 foot wide alley as platted in Block 2 Ricker and Bratnober' s Addition, more particularly described as East of a line drawn from the Northwest corner of Lot 14 Block 2 to the Southwest corner of Lot 8 Block 2 said addition, and West of a line drawn from the Northeast corner of Lot 16 Block 2 to the Southeast corner of Lot 6 Block 2 said addition, subject to the City' s retention of a permanent utility easement over, under and above the above described property, all in the City of Waterloo, Black Hawk County, Iowa; and also, sell and convey to Devera Sugtherland, the vacated portion of the east-west alley generally located westerly of East 4th Street between Mosley and Ricker Streets, described as follows : That part of the North one-half of the vacated 10 foot wide east-west alley in Block 2 of Ricker and Bratnober' s Addition that lies East of the extension Southerly of the West line of Lot 6 Block 2 said addition: Also, that part of the South one-half of the vacated 10 foot wide east-west alley in Block 2 of Ricker and Bratnober' s Addition that lies East of the extension Northerly of a line sixteen feet (16' ) East of and parallel to the West line of Lot 16 Block 2 said addition, subject to the City' s retention of a permanent utility easement over, under and above the above described property, all in the City of Waterloo, Black Hawk County, Iowa; for $196. 80, plus costs; and also, sell and convey to Jerome and Leoda Amos, the vacated portion of the east-west alley generally located westerly of East 4th Street between Mosley and Ricker Streets, described as follows : That part of the North one-half on the vacated 10 foot wide east-west alley in block 2 of Ricker and Bratnober' s Addition that lies West of the extension Southerly of the West line of Lot 6 Block 2 said addition: Also, that part of the South one-half of the vacated 10 foot wide east-west alley in Block Resolution 1999-606 Page 2 2 of Ricker and Bratnober' s Addition that lies West of the extension Northerly of a line sixteen feet (16' ) East of and parallel to the West line of Lot 16 Block 2 said addition, subject to the City' s retention of a permanent utility easement over, under and above the above described property, in the City of Waterloo, Black Hawk County, Iowa; for $492 . 00, plus costs. Section 2 . That the City Clerk is hereby directed to publish notice of the time and place of said hearing in the Waterloo Courier.
