RESOLUTION NO. 1999-638
RESOLUTION FIXING THE TIME AND PLACE OF
HEARING AND NOTICE TO BE GIVEN ON THE
VACATION OF A PORTION OF THE PLATTED DRAINAGE
EASEMENT GENERALLY LOCATED JUST SOUTH OF THE
WAL-MART STORE LOCATED AT 1334 FLAMMANG
DRIVE, AS OCTOBER 4, 1999, AT 7 : 00 P.M. IN
CITY HALL COUNCIL CHAMBERS, WATERLOO, IOWA
AND INSTRUCTING THE CITY CLERK TO PUBLISH THE
NOTICE OF HEARING.
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF WATERLOO, IOWA,
AS FOLLOWS:
Section 1 . That the Council of the City of Waterloo, Iowa
shall meet at City Hall Council Chambers in the City of Waterloo,
Iowa at 7 : 00 p.m. on the 4th day of October, 1999, for the purpose
of considering and acting upon a proposal to vacate a portion of
the platted drainage easement generally located just south of the
Wal-Mart Store located at 1334 Flammang Drive for expansion of
their building, and legally described as follows:
Being a part of Lot 1 of Crossroads Plat No. 3 as
recorded in the Plat Book "W", page 85, City of
Waterloo, Black Hawk County, Iowa and being more
particularly described as follows:
Commencing at an Iron Pin set at the Southeast corner
of said Lot 1 thence; N 00°05' 00" W along the East
boundary line of said Lot 1 and the West right-of-way
line of Sarah Drive (a 60 feet right-of-way) , 69. 76
feet to the point of beginning. Thence S 89°51' 36" W,
215. 83 feet to a point; thence N 00°05' 00" E, 24 . 97 feet
to a point; thence N 89°47' 16" E, 215. 87 feet to a point
in East boundary line of said Lot 1 and the West right-
of-way line of Sarah Drive; thence S 00°05' 00" W, 25. 25
feet to the point of beginning, containing 0 . 1244 acres
(5419. 98 square feet) of land, more or less, all in the
City of Waterloo, Black Hawk County, Iowa;
and also;
Being a part of Lot 1 of Crossroads Plat No. 3 as
recorded in the Plat Book "W", page 85, City of
Waterloo, Black Hawk County, Iowa and being more
particularly described as follows :
Commencing at an Iron Pin found at the Southwest corner
of said Lot 1, thence N 00°05' 00", 69. 18 feet to the
point of beginning. Thence N 00°05' 00" E, 5. 82 feet to a
point; thence N 89°48' 49" E, 205 . 00 feet to a point;
thence N 00°05' 00" E, 20 . 00 feet to a point; thence N
89°49' 00" E, 60 . 44 feet to a point; thence S 00°08' 59"
W, 25. 99 feet to a point; thence S 89°51' O1" W, 265. 54
feet to the point of beginning, containing 0 . 0638 acres
(2, 778 . 81 square feet) of land, more or less, all in
the City of Waterloo, Black Hawk County, Iowa.
Section 2 . That the City Clerk is hereby directed to publish
notice of the time and place of said hearing in the Waterloo
Courier.
