RESOLUTION NO. 1999-652 RESOLUTION ACCEPTING AND APPROVING CERTAIN ACQUISITION CONTRACT TO SELL REAL PROPERTY TO THE CITY AND ACCEPTING AND APPROVING CERTAIN DEEDS . WHEREAS, the City of Waterloo, Iowa, has had all the parcels described herein appraised and the fair market value ascertained, and WHEREAS, the acquisition of the hereinafter described parcels is necessary to carry out the Martin Luther King Jr. Drive/Bishop Avenue Extension Project Acquisition. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF WATERLOO, IOWA, that the contract for the parcels hereinafter described to sell the same to the City of Waterloo, Iowa, all of which are situated in the City of Waterloo, Black Hawk County, Iowa, are accepted and approved and the Mayor and City Clerk are authorized and directed to execute the same in behalf of the City and to execute all instruments necessary to consummate the agreement to purchase the properties from the owners thereof, and the deed for the conveyance of the same is also accepted and approved and the City of Waterloo is directed to pay for the properties and the incidental expenses necessary to the consummation of the sales from City funds . The subject parcels are : Parcel No. 102 Joan E. Tietz, Owner Partial Acquistion-$3 , 00 . 00 A parcel of land located in the Southeast 14 of the Southwest 14 of Section 20, Township 89 North, Range 12 West of the Fifth Principal Meridian, in the City of Waterloo, Black Hawk County, Iowa, more particularly described as follows : Commencing at the Southwest corner of said Section 20; thence North 89°32 ' 32 " East on the South line of the Southwest % of said Section 20 a distance of 1, 543 . 50 feet; thence North 00°41 ' 58 " West a distance of 852 . 72 feet to the point of beginning of the parcel herein described; thence continuing North 00°41 ' 58 " West a distance of 137 .28 feet to a point which is 1, 543 . 90 feet East of the West line of the Southwest 14 of said Section 20 (as measured parallel with the South line of the Southwest 1/ said Section 20) ; thence North 89°32 ' 32 " East a distance of 88 . 00 feet; thence South 00°41 ' 58 " East a distance of 44 . 27 feet; thence Southwesterly on a 641 . 20-foot radius curve concave Southeasterly and having a 127 . 77-foot long chord bearing South 42°49 ' 45 " West a distance of 127 . 99 feet (arc length) to the point of beginning; containing 0 . 18 acre, all in the City of Waterloo, Black Hawk County, Iowa. Tietz, Owner Partial Acquistion-$500 . 00 A parcel of land located in the Northeast 1/ of the Southwest % of Section 20, Township 89 North, Range 12 West of the Fifth Principal Meridian, in the City of Waterloo, Black Hawk County, Iowa more particularly described as follows : Commencing at the Southwest corner of said Section 20; thence North 89°32 ' 32 " East on the South line of the Southwest 1/ of said Section 20 a distance of 1, 631 . 50 feet; thence North 00°41 ' 58 " West a distance of 945 . 74 feet to the point of beginning of the parcel herein described; thence continuing North 00°41 ' 58 " West a distance of 44 .27 feet to a point which is 1, 631 . 90 feet East of the West line of the SW 1/ of said Section 20 (measured parallel with the South line of the Southwest 1/ of said Section 20) ; thence North 89°32 ' 32 " East a distance of 57 . 34 feet; thence Southwesterly on a 641 .20-foot radius curve concave Southeasterly and having a 72 . 29-foot long chord bearing South 51°46 ' 43 " West a distance of 72 . 33 feet (arc length) to the point of beginning; containing 0 . 03 acre, all in the City of Waterloo, Black Hawk County, Iowa.
