RESOLUTION NO. 1999-663
RESOLUTION AUTHORIZING THE CONDEMNATION OF
CERTAIN PARCELS OF REAL PROPERTY FOR THE
REDEVELOPMENT OF THE OSCO BUILDING.
WHEREAS, Main Street Waterloo, has undertaken the
construction of a parking lot and associated aesthetic
improvements to the core area bounded by East 4th Street, East 5th
Street and Lafayette Street and the parcels of land hereinafter
described have been appraised and an offer made to the owners of
said property in the amount of the appraised value and said offers
have been refused and funds are available with which to pay for
the said parcels from City funds; and
WHEREAS, the acquisition, by Temporary Easement, Permanent
Easement, or Fee Simple Title of the hereinafter described real
property is necessary in connection with the said redevelopment of
the Osco Building.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF WATERLOO, IOWA, that the following described parcels of
real property be acquired by condemnation in the manner provided
by law, and such other further action as may be necessary to
effect acquisition:
Parcel No. 891325103019 - James and Nancy Higgins, Owners
That part of Lots Nos . One (1) , Two (2) , Three (3) , Four (4)
and Five (5) , in Block Fourteen (14) , Original Plat, East Side of
the Cedar River, Waterloo, Black Hawk County, Iowa described as
follows :
Beginning at a point on the Southwesterly line of
Lafayette Street that is 100 feet Southeasterly from
the North corner of said Block 14; thence Southwesterly
parallel with Fourth Street 40 feet; thence
Southeasterly parallel with Lafayette Street, 12 feet
more or less to a point on a line that is at right
angles to Lafayette Street at a point 38 feet from the
Easterly corner of said Lot 2 ; thence Southwesterly on
the above described line 0 feet; thence Southeasterly
parallel with Lafayette Street 4 . 5 feet more or less to
a point that is 33 . 5 feet from the Southeasterly end of
said Lot 3 ; thence Southwesterly parallel with the
Southeasterly end of said Lot 3 to a point that is 20
feet from the Southwesterly line of said Lot 3 ; thence
Northwesterly parallel with the Southwesterly line of
said Lot 3 to a point that is 110 feet from Fourth
Street; thence Southwesterly parallel with Fourth
Street 10 feet; thence Southeasterly parallel with and
10 feet from the Southwesterly line of said Lot 3 to
the Southeasterly end of said Lot 3 ; thence
Southwesterly along the line between Lots 3 and 4, 10
feet to the corner between said Lots 3 and 4 ; thence
continuing Southwesterly along the line between Lots 5
and 6, 30 feet; thence Southeasterly parallel with the
line between said Lots 4 and 5 to a point that is
108 . 22 feet from the Northwesterly line of Fifth
Street; thence Northeasterly parallel with Fifth
Street, 30 feet to a point on the line between said
Lots 4 and 5 that is 41 feet Southeasterly from the
West corner of Said Lot 4; thence Southeasterly along

the line between said Lots 4 and :5, 14 . 19 feet to a
point that is 94 feet from Fifth Street; thence
Northeasterly on a line that is parallel with and 94
feet from the Northwesterly line of Fifth Street to the
Southwesterly line of said Lot 1; thence Northwesterly
to the center of a 16 inch brick wall now in place;
thence Northeasterly along the center of the said brick
wall to the Southwesterly line of Lafayette Street, at
a point 94 . 60 feet from the East corner of said Lot 1;
thence Northwesterly along the Southwesterly line of
Lafayette Street 103 . 58 feet to the point of beginning,
and the Southeasterly 25 feet of the Northwesterly 66
feet of the Northeasterly 30 feet of Lot No. 5 in said
Block 14, all in the City of Waterloo, Black Hawk
County, Iowa.
NOW, THEREFORE, BE IT FURTHER RESOLVED BY THE CITY COUNCIL OF
THE CITY OF WATERLOO, IOWA, that if the owners of said property
and the City of Waterloo, Iowa, agree to a settlement prior to the
time and date for commencement of condemnation proceedings, such
further action relating to the condemnation shall be null and void
and the Mayor and City Clerk be authorized and directed to execute
all instruments necessary to consummate the agreement to purchase
the properties from the owners thereof, and the deeds for the
conveyance of the same are also accepted and approved and the City
of Waterloo is directed to pay for the properties and the
incidental expenses necessary to the consummation of the sales
from City funds .
