RESOLUTION NO. 1999-680 RESOLUTION AUTHORIZING THE SALE AND CONVEYANCE OF A PARCEL OF LAND GENERALLY LOCATED SOUTH OF THE WAL-MART STORE LOCATED AT 1334 FLAMMANG DRIVE TO WAL-MART, INC. FOR $1. 00, PLUS COSTS AND AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE AND DELIVER A DEED FOR SAME. WHEREAS, the City of Waterloo, Iowa, is the owner of real property in the City of Waterloo, Iowa, as described below, and WHEREAS, an offer to purchase said certain parcel of real property in the sum of $1. 00, plus costs, has been made by Wal- Mart, Inc. , and WHEREAS, a public hearing was held on October 4, 1999, at 7 : 00 p.m. in the Council Chambers in City Hall, Waterloo, Iowa, as provided by law, by the Council of the City of Waterloo, Iowa, on the proposal to sell and convey premises owned by the City of Waterloo, Iowa, to Wal-Mart, Inc. , and WHEREAS, it is the opinion of this Council that sale and conveyance should be made as proposed. NOW, THEREFORE, IT IS HEREBY RESOLVED BY THE COUNCIL OF THE CITY OF WATERLOO, IOWA, AS FOLLOWS: 1 . The following described real property, as fully described in the published notice in the Waterloo Courier on September 24, 1999, is not presently needed and will not be needed in the foreseeable future for municipal purposes and its ownership is serving no municipal purpose, and 2 . That the offer of Wal-Mart, Inc. to purchase real property for the sum of $1 . 00 and costs be, and it is hereby accepted for real property described below: South One Hundred (100) feet of the following: Unplatted Waterloo West. Part SW k SW k Section 2 T88 R13 commencing at the Southwest corner said Section 2 thence due East 1, 317 . 85 feet along the South line of Section 2 to the Southeast corner of the SW k SW k Section 2 thence North along East line SW k SW k a distance of 33 feet to the point of beginning, thence continuing North along said East line a distance of 710 . 7 feet thence South 48°48' West 266. 9 feet thence South 00°17 11' West 534 . 9 feet thence South 90°00' East 200 feet to the point of beginning, all in the City of Waterloo, Black Hawk County, Iowa; Subject to the city' s retention of a permanent easement over, under and above the following described property: Being a part of the City of Waterloo, Black Hawk County, Iowa and being more particularly described as follows : Commencing at an Iron Pin found at the Southwest corner of Lot 1 of Crossroads Plat No. 3 as recorded in the Resolution No . 1999-680 Page 2 Plat Book "W", page 85, point of beginning. Thence S 89°48' 49" W, 200. 00 feet to a point; thence N 00°05' 00" W, 78 . 49 feet to a point; thence S 74°36' 19" E, 68 . 05 feet to a point; thence S 82°35' 15" E, 98 . 43 feet to a point; thence N 86°52' 59" E, 36. 80 feet to a point; thence S 00°05' 00" W, 49. 08 feet to the point of beginning, containing 0 . 2655 acres (11, 563 . 87 square feet) of land, more or less, all in the City of Waterloo, Black Hawk County, Iowa; 3. That the City of Waterloo, Iowa, convey said parcel of real property to Wal-Mart, Inc. by Deed. 4 . That the Mayor and City Clerk are hereby authorized to execute and deliver deed to Wal-Mart, Inc. 5. That the original of said deed fully executed and acknowledged is hereby approved and confirmed by the Council. 6. That the City Clerk is authorized and directed to deliver said deed of conveyance to Wal-Mart, Inc. upon receipt of the sum of $1. 00, and costs . PASSED AND ADOPTED this 4th day of October, 1999.
