RESOLUTION NO. 1999-723
RESOLUTION FIXING THE TIME AND PLACE OF
HEARING AND NOTICE TO BE GIVEN ON THE
VACATION, SALE AND CONVEYANCE OF A PORTION OF
MARY ELLEN DRIVE GENERALLY LOCATED SOUTHWEST
OF WILLIAM DRIVE TO MERLE B. LAMPE AND YOUNG
DEVELOPMENT AS NOVEMBER 8, 1999, AT 7 : 00 P.M.
IN CITY HALL COUNCIL CHAMBERS, WATERLOO, IOWA
AND INSTRUCTING THE CITY CLERK TO PUBLISH THE
NOTICE OF HEARING.
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF WATERLOO, IOWA,
AS FOLLOWS:
Section 1. That the Council of the City of Waterloo, Iowa
shall meet at City Hall Council Chambers in the City of Waterloo,
Iowa at 7 : 00 p.m. on the 8th day of November, 1999, for the
purpose of considering and acting upon a proposal to vacate a
portion of Mary Ellen Drive generally located southwest of William
Drive, and legally described as follows:
That part of Ellen Drive (also known as Mary Ellen
Drive) as platted in First Addition to Klingaman
Knolls, Black Hawk County, Iowa (Now in the City of
Waterloo) , lying Southwesterly of the Southwesterly
line of William Drive, subject to the city' s retention
of a permanent easement over, under and above the above
described property, all in the City of Waterloo, Black
Hawk County, Iowa;
and also, sell and convey to Merle B. Lampe a portion of vacated
Mary Ellen Drive generally located southwest of William Drive,
described as follows:
The Northwesterly one-half of vacated Mary Ellen Drive
right-of-way lying Southwesterly of the Southwesterly
line of William Drive, subject to the city' s retention
of a permanent easement over, under and above the above
described property, all in the City of Waterloo, Black
Hawk County, Iowa
for $4, 176. 00, plus costs;
and also, sell and convey to Young Development, a portion of
vacated Mary Ellen Drive generally located southwest of William
Drive, described as follows :
The Southeasterly one-half of vacated Mary Ellen Drive
right-of-way lying Southwesterly of the Southwesterly
line of William Drive, subject to the city' s retention
of a permanent easement over, under and above the above
described property, all in the City of Waterloo, Black
Hawk County, Iowa.
for $4, 176. 00, plus costs.
Section 2 . That the City Clerk is hereby directed to publish
notice of the time and place of said hearing in the Waterloo
Courier.
