RESOLUTION NO. 1999-725
RESOLUTION APPROVING AND ACCEPTING A
PERMANENT EASEMENT FROM NATIONAL CATTLE
CONGRESS TO ALLOW ACCESS TO THE SANS SOUCI
ISLAND BY-PASS CHANNEL WING DAM FOR
MAINTENANCE PURPOSES.
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF WATERLOO, IOWA,
that the Permanent Easement, dated October 25, 1999, from National
Cattle Congress to allow access to the Sans Souci Island By-Pass
Channel Wing Dam, described as follows :
National Cattle Congress-Permanent Easement
That part of the Waterloo Cattle Congress property in
Sections 21 and 22, Township 89, Range 13, West of the
5th Principal Meridian, in the City of Waterloo, Black
Hawk County, Iowa, lying twenty-five (25) feet on both
sides of a centerline described as follows :
Commencing at the Northwest corner of Lot 2 Blk 2
Groveland Addition, thence S 89°50' 39" W a distance of
seven hundred thirty-seven and twenty-nine hundredths
(737 . 29) feet to the point of beginning of the
centerline of easement; said point also being the point
of a spike located on the centerline of an existing
tunnel lying Northerly and Easterly of the intersection
of Highway 218 at Ansborough Avenue; thence N 41°19' 45"
W a distance of four hundred two and seventy-eight
hundredths (402 . 78) feet; thence N 50°29' 50" W a
distance of five hundred eighty-one and nineteen
hundredths (581 . 19) feet; thence N 45°31' 00" W a
distance of one hundred nineteen and thirty-two
hundredths (119 . 32) feet; thence N 16°38' 28" E a
distance of five hundred fifty-three and sixty-nine
hundredths (553 . 69) feet; thence N 17°50' 23"W a
distance of one hundred thirty-five and thirty-one
hundredths (135 . 31) feet; thence N 46°35' 52" W a
distance of one hundred twenty-seven and eight
hundredths (127 . 08) feet; thence N 31°45' 29" W a
distance of one hundred eighty-three and thirty-five
hundredths (183 . 35) feet; thence N 13°39' 20" E a
distance of four hundred fourteen and sixty-seven
hundredths (414 . 67) feet; thence N 55°52' 18" E a
distance of seventy-one and seventy-one hundredths
(71 . 71) feet; thence N 77 °34' 27" E a distance of
twenty-three and forty hundredths (23 . 40) feet to a
point on the Wing Dam of the Cedar River Bypass
Channel; also being the endpoint of centerline herein
described;
be and the same is hereby approved and accepted.
PASSED AND ADOPTED this 25th '.ay of October, 1999, and
approved by the Mayor on the 27th d. of October, 1999.

PERMANENT EASEMENT
1. The Cattle Congress does hereby grant and convey unto the City of
Waterloo, Iowa, a permanent easement across the following described
property in the City of Waterloo, Black Hawk County, State of Iowa:
That part of the Waterloo Cattle Congress property in
Sections 21 and 22, Township 89, Range 13, West of
the 5th Principal Meridian, in the City of Waterloo,
Black Hawk County, Iowa, lying twenty-five (25) feet
on both sides of a centerline described as follows:

distance of seventy-one and seventy-one hundredths
(71.71) feet; thence N 77°34'27" E a distance of
twenty-three and forty hundredths (23.40) feet to a
point on the Wing Dam of the Cedar River Bypass
Channel; also being the endpoint of centerline herein
described;
for the purpose of maintaining the San Souci Island Bypass Channel
Wing Dam together with right of ingress and egress thereon (See also
page 4);
2. The City hereby agrees to notify and obtain authorization from the Cattle
Congress before maintenance personnel or vehicles enter Cattle
Congress property for the purpose of maintaining the Sans Souci Island
Bypass Channel Wing Dam.

3. The City agrees that upon completion of maintenance activity to the
above mentioned Wing Dam, Cattle Congress property used as part of
the permanent easement shall be returned to the same or substantially
similar condition as it existed prior to the authorization to use the
permanent easement.
4. In the event a contractor authorized to use the permanent easement
causes damage or loss of property, other than within the permanent
easement, the contractor shall be solely liable for any such damage or
loss. Cattle Congress understands and agrees that it shall have no cause
of action against the City, but shall proceed against the contractor for
any damage or loss incurred upon its property.
