RESOLUTION NO. 1999-749 RESOLUTION FIXING THE TIME AND PLACE OF HEARING AND NOTICE TO BE GIVEN ON THE VACATION, SALE AND CONVEYANCE OF THE 30 FOOT ALLEY ABUTTING PROPERTY GENERALLY LOCATED BETWEEN THE UNIVERSITY DAIRY QUEEN AND WAYNE CLAASSEN ENGINEERING AND SURVEYING, INC. , AS NOVEMBER 22, 1999, AT 7 : 00 P.M. IN CITY HALL COUNCIL CHAMBERS, WATERLOO, IOWA AND INSTRUCTING THE CITY CLERK TO PUBLISH THE NOTICE OF HEARING. BE IT RESOLVED BY THE COUNCIL OF THE CITY OF WATERLOO, IOWA, AS FOLLOWS: Section 1. That the Council of the City of Waterloo, Iowa shall meet at City Hall Council Chambers in the City of Waterloo, Iowa at 7 : 00 p.m. on the 22nd day of November, 1999, for the purpose of considering and acting upon a proposal to vacate the 30 foot alley abutting property generally located between the University Dairy Queen and Wayne Claassen Engineering and Surveying, Inc. , and legally described as follows: All of the Thirty (30) foot alley as platted in Kearns' Addition to the City of Waterloo, Iowa, lying Southeasterly of the Southwesterly extension of the Northwest line of Lot 42 in said Addition and all of that alley as platted in said Addition lying Southeasterly of the Southeast line of said Lot 42, subject to the city' s retention of a permanent easement over, under and above the above described property, all in the City of Waterloo, Black Hawk County, Iowa; and also, sell and convey to Wayne Claassen Engineering and Surveying, Inc. , a portion of the vacated 30 foot alley abutting property generally located between the University Avenue Dairy Queen and Claassen Engineering, described as follows : The Southeasterly Five (5) feet of the Thirty (30) foot alley as platted in Kearns' Addition to the City of Waterloo, Iowa, said Five (5) foot strip adjoining Lots 39, 40 and 41 in said Addition, subject to the city' s retention of a permanent easement over, under and above the above described property, all in the City of Waterloo, Black Hawk County, Iowa; for $1 . 00, plus costs; and also, sell and convey to Curly Cone, LTD, a portion of the vacated 30 foot alley abutting property generally located between the University Avenue Dairy Queen and Claassen Engineering, described as follows: All of the Thirty (30) foot alley as platted in Kearns' Addition to the City of Waterloo, Iowa, lying Southeasterly of the Southwesterly extension of the Northwest line of Lot 42 in said Addition and all of that alley as platted in said Addition lying Southeasterly of the Southeast line of said Lot 42 except the Southeasterly Five (5) feet adjoining Lots 39, 40 and 41, subject to the city' s retention of a permanent easement over, under and above the above Resolution 1999-749 Page 2 described property, all in the City of Waterloo, Black Hawk County, Iowa; for $1 . 00, plus costs. Section 2 . That the City Clerk is hereby directed to publish notice of the time and place of said hearing in the Waterloo Courier. PASSED AND ADOPTED this 8th day of November, 1999.
